2021年9月26日（日曜日）即日判明した国民投票の結果は次の通り。*1)

弊誌 Vol. 201 - September 20, 2021もご参照されたし。 *2）

1) 国民発議「賃金の税負担を減らし、資本利得に公平な課税」

通称「99％イニシアティブ」の投票結果は、

賛成35.12％、反対64．88％、投票率は52.23％で平均以上。

賛成多数のカントンは皆無。*3)

政治学者ルーカス・ゴルダｰ氏は、Juso（社会民主党青年部）、SP（社会民

主党）、Greens（緑の党）は、彼等の支持者以外からの支持を得ることが出

来ず、税の正義を築くという要求で明らかに失敗したと分析した。

要するに、頭でっかちの危なっかしい社会実験には付き合えないと、実利的

なスイスの大人の有権者に判断されたという結果であろう。

2) 「婚姻を全ての人に」

結果は、賛成64.10％、反対35.90％、投票率は52.60％。

全カントンが賛成多数だった。*4)　予想通り議案は有権者に承認された。

只、この法律に反対する国民投票委員会は、結婚を男女間の結びつきとして

守ろうとしているので、レズビアンカップルへの精子提供は、子供の父親不

在やアイデンティティの問題につながるという考えだ。

又、この改正法は違憲であるとも主張している。

2021年9月28日付「ヴェルトヴォッヘ誌」オンライン版で、トーマス・レン

グリ記者は、「すべてのカントンがすべての人に結婚をと投票した。

この法律が憲法に違反していることを誰も気にしていないようだ」と、

問題提起し、次のように解説している。*5)

[引用]　1996年11月20日付の連邦憲法に関する記述を見ると、第12条「婚姻

の権利」には誤解の余地がない。「連邦憲法第54条の歴史的解釈と欧州人権

裁判所の判例によれば、婚姻権は女性と男性の結合を保証するものである。

また、ニューハーフ同士の結婚や同性同士の結婚には適用されない。

同様に、欧州人権条約第12条では、すべての男女が結婚して家庭を築く権利

が認められているが、それは性別の異なる2人の間での結婚であることが条

件。結婚という制度は、常に伝統的なカップルを対象としている。現在のあ

らゆる形態の同棲に拡大解釈することは、結婚という制度の基本的な考え方

に反することになる。[引用終了]

これは、違憲審査を政府と立法機関が怠っていたことになる。そして、違憲

の法律が国民投票で承認されてしまった！先ず、憲法を改正した後に法制化

されるべき議案だったことになる。しかし、これまでのところ、他のメディ

アは沈黙している。現実には、同性婚を既に認めている国が欧州には多数あ

る。この程スイスも仲間入りしたわけだ。

いずれにせよ、全ての人が結婚出来る法律を定めることに異論は無いが、

議案の中の子供の扱いに関する部分には疑問の余地がある。賛成派の論争の

中で、「子供の福祉」という視点が疎かにされている。

ターゲス・アンツァイガー紙で紹介されたレスビアンカップルは、「結婚し

たら子供は勿論欲しい。精子提供か、異性のパートナーが出来れば、いずれ

かで」と仰天発言。かつて違法な養子縁組で、例え養父母に愛情深く育てら

れても、実の親を探し続ける人々が多くいる事が報じられている。

現代社会は寛容を求めながらも、大人社会でも子供社会でもデジタル技術を

も媒介にして、差別やいじめが横行している。子供が「生まれてきてよかっ

た」、と思える最低限の態勢で子供を作るのが親としての責任ではないかと

思う。例えば、「人間の五感の形成の起源」は、「乳幼児の時、あるいは授

乳のときに母親から受け取った視線にあると考えられている。」というブロ

グで、乳幼児と親との直接の触れ合いの重要さを、科学的考察によって示し

ている。*6）これは近年よく話題になる神経伝達物質オキシトシンの関与も

ありそうだ。*7)

殆どすべての家庭は、子供の問題を抱えていると言えるのではないだろう

か？「Kleine Kinder, kleine Sorgen, Grosse Kinder, grosse Sorgen.

(小さい子供は小さい心配、大きい子供は大きい心配)」と言われるように、

子育ては大きな責任を伴う一生の課題ではある。人工授精や精子提供等の

問題は、自然の摂理と相容れない人工的技術に思える。倫理的な視点から

も、もっと時間を掛けて、国民的議論を深める必要があるテーマだ。

「スイス政界の変化：閣僚構成改編の争点」

連邦議会に代議員がいる政党は、11政党ある。*8）

会派があるのは6政党。*9)

最近、主要政党の党首交代が進み、名前を知っている党首は1人だけになってしまった。政党の党首は激務にもかかわらず、経費の支給はあるようだが、基本的に無報酬という政党があるのが、根本原因と言われている。

現職の党首については、次の機会にお伝えしたいと思案している。

2021年10月16日付けターゲス・アンツァイガー紙が、連邦政府（連邦評議員又は連邦参議院）の椅子の配分について、「緑の党」が議論を提起したことを、「マジックフォーミュラの議論再始動」という表題で詳報した。*10) *11) *12)

きっかけはSRGの選挙バロメーターで現在の投票動向が示された事による。括弧内は2019年選挙の得票率。

現在連邦政府の7つの椅子は、SVP（スイス国民党）、SP（社会民主党）、FDP（自由民主党）が各2席、Die Mitte（旧CVPキリスト教国民党）が1席を占めている。*8）この配分の根拠は、各政党の得票率にある。

SVP：最大政党で保守の最右翼の支持率は、26.6％（+1.0）と安定している。閣僚の二つの椅子は安泰だ。

SP：第二党で左派の盟主は15.8％で（-1.0）と陰りが出ている。

暫く前に交代した、若手共同代表の存在感が希薄なことに加えて、今回の

国民投票「99％イニシアティブ」への支持が広まらなかった。最近、２人の

閣僚による依怙贔屓人事と部下への圧力が報じられた。現在維持している

二つの閣僚の椅子を、２年後の選挙後でも維持できるか行方が注目される。

FDP：経済界が支持基盤の中道保守政党は13.6％（-1.5）で低落傾向が著し

い。前党首が国民投票で左派寄りの政策を主導して失敗し、年内の辞任を

表明していた。新しい党首が選出されたばかりだが、支持率を浮揚出来る

か否かは今後の課題だ。

Die Mitte：キリスト教系中道保守の同党は「BDP」と合併したものの、

13.3％（-0.5）と支持率低迷から抜け出せずにいる。

緑の党：気候変動に取り組む緑の党は13.2％（0.0）と、世界的な気候変動

への動きに乗じて２年前の選挙で大躍進した。支持率が同列のFDPが、二閣僚の椅子を占めている現状は容認し難いと主張して、FDPから閣僚ポスト１席を獲得しようとしたが失敗に終わった。同党は40年の歴史を有し、全州議会にも代議員を擁しているので、相応のステータスが有ると自負している。

しかし、FDPや議会の大勢は、今連邦政府の構成員を変えることには消極的で、緑の党は、先ず自分たちの存在を証明し、成功を確認する為に、次の選挙まで待つべきという姿勢だ。

GLP：グリーンリベラルは9.8％　（+2.0）と最も支持率を伸ばしているが、さほど目立たず報道が限られているので、支持率上昇の理由は明らかではない。

EVP：福音国民党は2.1％（0.0）と支持率に変化無し。*13）

政策はテーマに依って立ち位置が異なる。

各党の現状は以上の通りだが、話題になってはたち消える閣僚を9人にする

案も再浮上しているそうだ。時代の変化と共に、各閣僚の守備範囲の変更も

検討する時期に来ているのかもしれない。しかし、人数で現状を維持しよう

が増やそうが、容易に決着する事案でないことは確かだ。

The Results of the Popular Vote on September 26, 2021

and Changes in Swiss Politics

The Results of the Popular Voting, published the same Day on Sunday,

September 26, 2021, were as follows *1)

1) Popular Initiative: "Reduce Tax on salaries, tax Capital fairly"

The Results of the Vote on the Initiative, known as the "99%

Initiative," were 35.12% Yes, 64.88% No, and the Turnout of Voters

was 52.23%, which is above Average.

No Canton approved the Initiative. *3)

Political Scientist Lukas Golder said that the Parties Juso (Young

Socialist), SP (Socialist Party) and Greens failed to gain Support

from anyone other than their own Supporters and clearly failed

in their Demand to build up Tax Justice. In short, the pragmatic

Adult Swiss Electorate had decided that it cannot be bothered with

these heady and dangerous social Experiments.

2) "Marriage for All"

The Results were 64.10% Yes and 35.90% No, with a Turnout of Voters

of 52.60%.

All Cantons approved the Amendment of the Law. *4)

As expected, the Bill was approved by a Majority of the Voters.

However, the Referendum's Committee opposing the Amendment of

the Law believes that as they try to protect Marriage as a Union

between a Man and a Woman, Sperm Donation to Lesbian Couples will

lead to fatherless Children and Identity Issues.

They also argue that this Amendment is unconstitutional.

In the Online Edition of "weltwoche-daily" dated September 28, 2021,

Journalist Thomas Renggli wrote a rising Question: "All Cantons

voted for Marriage for All. No one seems to care that this Law

violates the Constitution", explaining it as follows. *5)

[Quote] However, if one looks at the Message of the Federal

Constitution dated November 20, 1996, there is no Room for

Misunderstanding under Article 12, "Right to Marriage". "According

to a historical Interpretation of Article 54 of the Federal

Constitution and in Accordance with the Case Law of the European

Court of Human Rights, the Right to marry guarantees the Union of

a Woman and a Man. It does not extend to Marriages between

Transsexuals or between People of the same Sex. Likewise,

Article 12 of the European Convention on Human Rights recognizes

the Right of every Man and Woman to marry and raise a family,

but only if the Marriage is between two People of different Gender.

The Institution of Marriage has always been focused on traditional

Couples. Today extending the current Interpretation to all Forms of

Cohabitation would be contrary to the basic Tenet of the Institution

of Marriage. [Unquote]

It seems to be a Failure of the Government and legislative Bodies

not to review an unconstitutional Amemdment of the Law. And now an

unconstitutional Law has been approved by popular Voting! This was

an Amendment that should have been passed into Law only after the

Federal Constitution had been amended first. But so far, the Rest of

the Media kept silent. In reality, there are many countries in

Europe that already recognize same-sex marriage. Switzerland has

just joined them.

Anyway, I have no Objection, establishing a Law that allows all

People to marry, but the Part of the Proposal concerning

the Treatment of Children is questionable. The Perspective of

"Children's Welfare" has been neglected in the Arguments in favor

of the Proposal.

The Lesbian Couple featured in the Newspaper "Tages-Anzeiger" said,

"Of course we want Children when we get married. Either through

Sperm Donation or by having a heterosexual Partner. "This is an

astonishing Statement. It has been reported that there are many

People who continue to search for their biological Parents,

even if they were raised lovingly by adoptive Parents through

an illegal Adoption.

While modern Society calls for Tolerance, Discrimination and

Bullying are rampant in both Adult and Children's Societies,

mediated also by digital Technology. I believe that it is our

Responsibility as Parents to provide our Children with the Minimum

Conditions that will make them feel that they are lucky to have been

born. For example, a Blog in "The Origins of the Formation of

the Five Human Senses," it says, "It is believed that the five

Senses originate in the Gaze, we receive from our Mothers when

we are Infants or when we are breast-fed. *6) This may be due to

the Involvement of Oxytocin, a Neurotransmitter that has been

occasionally referred in recent Years. *7)

It could be said that almost all Families have problems with their

Children. As the Saying goes, "Kleine Kinder, kleine Sorgen, Grosse

Kinder, grosse Sorgen." (Small Children, small Worries, big

Children, big Worries); raising a Child is a lifelong Task with

great Responsibility. Issues such as the artificial Insemination

and Sperm Donation seem to be artificial Technologies that are

incompatible with the natural Order of Things. From an ethical Point

of View, it is a Topic that requires more Time and national

Discussion.

"Changes in Swiss Politics: the contentious Issue of reorganizing

the ministerial Structure."

There are 11 political Parties that have Deputies in the Federal

Parliament. *8)

There are six Parties that have Factions. *9)

Recently, the major political Parties have been changing their Party

Leaders, and there is only one Leader whose name I know. It is said

that the Root Cause of this is that although they seem to be paid

for their Expenses, however some political Parties basically pay no

Remuneration to their Party Leaders, despite their intense Work.

I contemplate to tell you about the current Party Leaders

at the next Opportunity.

On October 16, 2021, the Newspaper Tages-Anzeiger reported in detail

under the Title "Die Diskussion um die Zauberformel ist neu

lanciert" (The Magic Formula Debate is back on). "The Green Party"

has begun to discuss the Allocation of Seats in the Federal

Government (Bundesrat). *10) *11)*12)

It was triggered by SRG's Election Barometer Survey, which shows

the current Voting Trends. In Parentheses is the Percentage of Votes

cast in the 2019 Election.

The seven Seats in the Federal Government are currently occupied by

the SVP (Swiss People's Party), SP (Social Democratic Party), FDP.

Die Liberalen (FDP.The Liberals) with two Seats each, and

"Die Mitte" (The Centre) [ex. CVP Christian Democratic People's

Party] with one Seat. *8) The Basis for this Allocation is the

Percentage of Votes each political Party receives.

SVP: The Support for the largest Party and the rightmost Wing of

the Conservative Parties is stable at 26.6% (+1.0%). There two

ministerial Seats are uncontested.

SP: The second Party and the Leader of the Left is fading at 15.8%

(-1.0%).

In addition to the tenuous Presence of the young Co-Chairs, who

were replaced some Time ago, Support for the JusoSP-Initiative

"99% Initiative" has not been widespread. Recently, there have been

Reports of Favoritism and Pressure on Subordinates by two Cabinet

Ministers. It will be interesting to see if the two ministerial

Seats they currently hold can be maintained after the Elections in

two Years.

FDP: The Centrist Conservative Party, whose Base of Support is the

Business Community, showed a marked downward Trend with 13.6%

(-1.5%). The previous Leader of the Party failed to lead a left-

leaning Policy in the Referendum and announced her Resignation by

the End of the Year. A new Leader has just been elected, but it

remains to be seen whether he will be able to boost the Party's

Popularity.

Die Mitte: The Christian, Centrist, Conservative Party merged with

the BDP and changed its Name, but is still stuck in a Slump with

a 13.3% (-0.5%) approval Rate.

Greens: The Green Party, which is committed to tackling Climate

Change, made a huge Leap forward in the Elections two Years ago with

13.2% (0.0%), taking Advantage of the global Climate Change

movement. The Party tried unsuccessfully to win one ministerial Seat

from the FDP so far, arguing that the current Situation, in which

the FDP, with the same Level of Support, occupies two ministerial

Seats, is unacceptable. The Party has a 40-year History and has

Deputies in the Council of States of Switzerland (Staenderat), so

it is proud of its Status. However, the FDP and many in Parliament

are reluctant to change the Composition of the Federal Government

right now, and the Greens should wait until the next Election to

prove themselves and confirm their Success.

GLP: The Green Liberals have seen the largest Increase in Support at

9.8% (+2.0%), but the Reason for the Increase is not clear as they

are not so visible and have limited Coverage.

EVP: The Evangelical People's Party has no Change in Support

at 2.1% (0.0%). *13) Policy Positions differ depending on the Theme.

The current Status of each Party is as described above, but the Idea

of having nine Ministers, which has been talked about and then

disappeared, has resurfaced. With the changing Times, it may be Time

to consider changing the Scope of each Cabinet Member. However,

whether the current Number of Ministers is to be maintained or

increased, it is certainly not a Matter that can be settled easily.

As for the current State of the political World, I was thinking

about the Change of Party Leadership and the Circumstances of

the various Parties involved, but as the Information became

available, I switched abruptly to the Issue of the Cabinet.
