202123日の会議で、連邦議会は2021613日の投票に次の提案を行う

ことを決定した。 *1)

 

1) 2018118日の国民発議「清潔な飲料水と健康食品のために -

   農薬および予防的抗生物質の使用に対する補助金除外」

2) 2018525日の国民発議「人工農薬のないスイスのために」

3) Covid-19 の流行に対処する連邦政府条例の法的根拠に関する20209

   25日の連邦法 (Covid-19 )

4) 2020925日の温室効果ガス排出削減に関する連邦法 (CO2 )

5) 2020925日付のテロ対策警察措置 (PMT) に関する連邦法

 

貯め込んだ国民投票の資料を眺めていると、どの議案も賛否両論入り交じり

混迷を感じざるを得ない。政党内でも意思統一が出来ていない議案があり、

保守政党か革新政党か賛否の傾向を判断することが出来ない議案もある。産

業界と経済界でも意見は分かれ、農業分野でも全国農業団体と小規模農家、

有機栽培農家で意見が分かれている。では、各議案を見てみよう。

 

1) 国民発議「きれいな飲料水と健康食品のために - 農薬と予防的抗生物

質の使用に助成金は無し」*2)

 

農民が連邦政府から直接補助金を受けるには、農民は特定の環境要件に準拠

しているという証拠を提供する必要がある。しかし、発議委員会はこれでは

不十分と考え、抗生物質を定期的または予防的に使用せず、無農薬で生産し、

農場で生産した飼料をすべての動物に与える農家にのみ補助金を支払うよう

求めている。連邦評議会と議会はイニシアチブの懸念を共有してはいるもの

の、要求は行き過ぎという認識だ。農薬によるリスクを減らす法改正は昨年

3月既に成立していると指摘。

 

イニシアチブが受け入れられれば、スイスの農業生産は激減し、外国からの

食料輸入が更に必要になるのは目に見えている。輸入先の国の環境や有機栽

培方法がスイスの基準と乖離している可能性は大きい。

 

連邦評議会と連邦議会は、 イニシアチブに「反対」を推奨。

議会の評決は、国民議会が賛成81票、反対が107票、棄権が7票。

全州議会は、賛成9票、反対31票、棄権4票。

左派政党とProNatura、とグリーンピースは賛成。

中道政党と保守政党、経済界、農業組合連合は反対。

 

2) 国民発議「合成農薬のないスイスのために」*3)

 

スイスでは農薬の使用が許可されているが、スイスで承認された製品のみ。

使途は、農業、食品の生産と加工、有害な生物や病原菌との闘い、景観や土

壌の維持。発議委員会は、こうした現状を不十分と考え発議した。スイスで

合成農薬の使用を禁止し、合成農薬を含む食品の輸入を禁止するよう求めて

いる。禁止を完全に実施するまでの移行期間を10年と考えている。

 

連邦政府は、既に農薬の使用に関する厳格な規則を定めている。研究と代替

案の開発も財政的に支援している。農薬の完全な禁止は、植物や農産物を細

菌やウイルスなどから保護できなくなる。従って、食品の供給と多様性を制

限し、消費者と生産者の両方に悪影響を与えるリスクを伴う。禁止は既存の

国際貿易協定にも違反することになる。又、議会は最近、農薬のリスクを減

らすことを目的とした法律改正を可決している。

 

連邦評議会と連邦議会は、 イニシアチブに「反対」を推奨。

議会の評決は、国民議会が賛成78票、反対が111票、棄権が7票。

全州議会は、賛成9票、反対31票、棄権4票。

左派政党と小規模農家組合とBio Suisseは賛成。

中道政党と保守政党、経済界、農業組合連合は反対。

グリーンリヴェラルは自主投票

 

2021525日付けターゲス・アンツァイガー紙の3頁に「農業について知っ

ておくべき事(Was Sie ueber die Landwirtschaft wissen muessen)」と

いう全面記事でスイス農業の現状をグラフ付で報じた。

論点は主に「農業への直接補助金28億スイスフランの内訳」、「家畜の内訳

推移」、「農薬販売量」「有機農業の割合」、「食料自給率」。

 

補助金の内訳は、生産障害に対する生産規模の確保が39%、耕作地の維持に

19%、有機栽培や動物に優しい生産システムに17%、生物多様性保全に15%、

資源効率に5%、景観維持に4%、過渡的拠出に1%となっている。

 

「家畜の内訳」は1975年を基準にすると、牛も豚も減少した一方で、鶏は

2020年倍増している。2020年の家畜の総数は、鶏が78%、牛が11%、豚は

8%。

 

「農薬販売量」は、2008年から2018年の間に、有機系農薬が増えており、

化学薬品系は減少傾向にある。

 

「有機農業の割合」は1990年から2020年迄で、耕作地が10%増加しており、

有機農家で飼育されている牛は14%、鶏は10%、豚は3%程度増えている。

 

こうしてみると、スイス農業は少しづつ乍らも、着実に進歩していると見え

る。消費者の実感として、有機栽培や持続可能な農業製品への取り組みも前

進している。耳障りの良い過激な規制を導入することは、自らの首を絞める

事になる。消費者は、農家を悪者にするのではなく、彼等の労働を評価し、

支援すべきと思う。

 

特に議論が集中した、国民発議2議案の通称「Agrarinitiativen(アグラール

・イニシアティヴ)は、一見説得力がありそうに見えたものの、かなり不用

意な内容であることが知られるようになって、賛成を得るには覚束ない形成

になってきた。食料生産で国土が不利な条件のスイスは、自給率が充分とは

言えず、食料の確保は安全保障上の重要課題だ。スイスの小売大手ミグロ、

コープ、デンナー各社も、アグラール・イニシアティブは食料の確保を困難

にすると警鐘を鳴らしている。

 

3) Covid-19の流行に対処するための連邦参事会の条例の法的根拠に基づく

2020925日の連邦法(Covid-19法)*5

 

20202月、コロナウイルスがスイスに到達して、重症者の数が急増した。

事態は急を要していたので、連邦政府は、危機の際に連邦憲法で許可されて

いる緊急法を制定した。この法律は、連邦政府に、コロナウイルスのパンデ

ミックと闘うための追加的権限を付与した。但し、その様な非常事態法は6

ヶ月に限定されている。必要な措置を引き続き講じることができるよう、連

邦政府と議会は、急遽COVID-19 法を起草し可決して、2020 9 月直ちに

発効させた。パンデミックの経済的影響に苦しむ人々や企業を支援するため、

短時間労働の補償、収入損失に対する補償、文化、スポーツ、報道機関への

支援等を決定した。

 

この新法に国民投票委員会(Referendumskomitees) が、民意を問わずに急遽

制定されたと異を唱え、国民投票が実施されることになった。その中には、

有害と認識されたメディアへの補助金などが含まれている。連邦政府と議会

は、法律は民主的な規則に従って可決されたもので、パンデミックの影響を

受けた人々への支援を必要な限り継続し、雇用を維持し、スイス企業の存続

を保証するために必要との立場だ。 この法律が否決された場合、20219

25日に期限切れになる。その日以降、危機に対処するための経済的支援の法

的根拠は無くなり、事態がどのように進むかについて非常に不確実な状況が

発生する可能性が出てくる。

 

連邦評議会と連邦議会は、 「賛成」を推奨。

議会の評決は、国民議会が賛成153票、反対が36票、棄権が6票。

全州議会は、賛成44票、反対0票、棄権0票。

中道と左派政党、労働組合、同業組合が賛成。

反対は、EDU(キリスト教系保守政党)、憲法擁護団体、妥当なコロナ政策

の為の原州行動同盟。保守最大政党SVPは自主投票。

 

人類が遭遇している異常事態であり、先ずは国民生活を最大限守る政策が求

められている。投票予測では、過半数の賛成を得て承認される見通しだ。

 

4) 温室効果ガス排出量の削減に関する2020925日の連邦法(CO2法)*6)

 

温室効果ガス、特に CO2 の排出は気候変動の主な原因で、人や環境に被害

を及ぼしている。猛暑日、干ばつ、洪水、地滑りは、スイスが特に大きな打

撃を受けている悪影響のほんの一部だ。対策として、連邦政府と議会はCO2

排出量を更に削減する戦略を策定し、この戦略をCO2法に包含させた。

 

この新法に国民投票委員会(Referendumskomitees) が異を唱え、この法律は

費用がかかり、スイスの CO2 排出量は世界の排出量の極一部でしかないの

で役に立たない。又、追加の税金や規制に直面する中流階級や中小企業にも

財政的な影響が及ぶ。

 

連邦政府と議会は、気候変動とそれに起因する悪影響は、国民や企業に罰則

を課すことなく、選択した戦略で制限できると確信している。この戦略は、

CO2の排出量が少ない個人や企業への金銭的インセンティブと還付、そして

気候保護と技術開発への投資によって実現される。ガソリンとディーゼル消

費が少ない車が市場に増える効果が期待されている。新しい法律は気候を保

護するだけでなく、新しい雇用を創出し、中小企業に追加の注文を生み出す。

又、外国の石油会社への依存を減らす。 新しいCO2法が拒否されれば、スイ

スは2030年までに1990年のレベルと比較して温室効果ガスの排出量を半減す

るという目標を達成できなくなることが確実になる(パリ協定)。

 

連邦評議会と連邦議会は、 「賛成」を推奨。

議会の評決は、国民議会が賛成129票、反対が59票、棄権が8票。

全州議会は、賛成33票、反対5票、棄権6票。

賛成は、中道と左派政党、経済界、スイス同業組合。

反対は、SVPEDU(キリスト教系保守政党)、住宅所有者協会、スイス自動

車クラブ。

 

端的に言うと、化石燃料代が高くなる法律のようだ。国民に抑制的な使用を

促す政府の政策で時代の流れと言えよう。個人的には、猛暑を緩和すること

に繋がるなら、自家用車にも飛行機にもなるべく乗らないように心掛ければ

済む話だ。中小の事業者も、長期的に、環境に優しい経営方針を選択するこ

とが、事業に有利になる筈だ。官僚主義的手続きが増えるという批判がある

ものの、投票性向は過半数の賛成を得て承認される見通しだ。

 

5) テロと戦うための警察措置に関する2020925日の連邦法(PMT*7)

 

連邦政府の説明は、2015 年のパリ同時多発テロ以降、テロの脅威は高まっ

ている。多くのカントンが、テロ対策の法律を強化している。スイスは近年、

継続的に対応手段の範囲を拡大しているものの、未だ幾つかの間隙がある。

それを埋める為、連邦政府と議会は、警察にテロの脅威に対する予防措置を

講じる追加手段を付与する新しい法的根拠を作成した。現在、警察が介入出

来るのは、犯罪を犯した場合のみ。

 

新しい法律に異議を唱える 2 つの委員会が、国民投票に漕ぎ着けた。彼等

は新しい対策がセキュリティ強化にならないと考える。それどころか、12

の子供から幾つかの措置を課すことができるので、人権と子供の権利が侵害

される。新しい法律が、司法の承認なしに、警察にただの疑いに基づいて対

策の手配と実行を許可する為、三権分立の危機ももたらす。彼らは又、政府

が承認しない政治活動を「テロ活動」と定義する可能性があると、法律の恣

意的な性格を強調する。

 

連邦政府と議会の見解は、法律は、テロ脅威の具体的かつ現実の兆候がある

場合にのみ、警察が住民を保護するために介入を許可している。自宅軟禁は

最後の手段であり、常に裁判所の承認が必要とされている。法の支配、基本

的権利、人権は尊重され、すべての決定は連邦行政裁判所に上訴することが

できる。この新しい法律は、テロと闘うためのスイスの3本柱の戦略、つまり

予防、抑止、社会復帰を補完するもの。

 

連邦評議会と連邦議会は、 「賛成」を推奨。

議会の評決は、国民議会が賛成112票、反対が84票、棄権が0票。

全州議会は、賛成33票、反対11票、棄権0票。

賛成は、中道と保守政党、EVP、スイス警察官協会。

反対は、左派政党、オペラシオン・リベロ、アムネスティー・インターナシ

ョナル、司教会議。

 

スイスでも市民社会に対するテロへの懸念は他人事では無いという現実があ

る。強権的な国家であれば、恣意的に運用されかねない内容の法律とは言え、

現在のスイスでは適切に運用されるという信頼から、議案は承認される見通

しだ。

 

【総論】

 

5つもの議案を提起された有権者は、賛否両論渦巻く中で翻弄される。タメ

ディア社 *8) SRFが発表した「gfs.bern 9*) の世論調査の最新の結果

は、は同様の傾向を示している。つまり、国民発議の「アグラール・イニシ

アティブ」2議案は否決され、COVID-19 法、CO2法、テロ対策連邦警察法は

承認される見通しだ。

直接民主制を否定はしない立場だが、国民発議が往々にして法制化するには

充分検証されたとは言い難い内容が多い事は問題だ。組織や政党の存在を誇

示する為の手段にしてはならない、と改めて思った。 (A.H.)

At the Meeting on February 3, 2021, the Federal Council (Swiss

Government) decided to put the following Bills and Initiatives to a

Vote on June 13, 2021 *1

 

1) Popular Initiative of January 18, 2018 "For clean Drinking Water

   and healthy Food - No Subsidies for the Use of Pesticides and

   prophylactic Antibiotics"

2) Popular Initiative of May 25, 2018 "For a Switzerland without

   artificial Pesticides"

3) Federal Law of 25 September 2020 on the legal Basis for

   Ordinances of the Federal Council to cope with the Covid-19

   Epidemic (Covid-19 Law)

4) Federal Act of 25 September 2020 on the Reduction of Greenhouse

   Gas Emissions (CO2 Act)

5) Federal Act of 25 September 2020 on Police Measures to Combat

   Terrorism (PMT)

 

Looking at the Material of the Popular Votes that I have accumulated,

I cannot help but feel confused about the Pros and Cons of each

Bill. Some political Parties have not been able to unify their

Intents; there are some Bills, for which it is not possible to

judge the Pros and Cons of a conservative Party or an Leftist party.

Opinions are divided between the Industrial World and the Business

World, and in the Agricultural Field, Opinions are also divided

between National Agricultural Organizations, the small-scale

Farmers, and Organic Farmers. So, let's take a look at each Bill.

 

1) Popular Initiative "For clean Drinking Water and healthy Food -

No Subsidies for the Use of Pesticides and prophylactic Antibiotics"

*2)

 

In order for Farmers to receive direct Subsidies from the Federal

Government, they need to provide Evidence that they are in

Compliance with certain Environmental Requirements. But the

Initiative Committee considers this inadequate and wants to

subsidize only Farmers who do not use Antibiotics on a regular or

prophylactic Basis, produce pesticide-free, and feed farm-produced

Feed to all their Animals. The Federal Council and the Parliament

share the Initiative's Concerns, but recognize that the Claims are

an Overkill. They pointed out that a Law Amendment to reduce the

Risk of Pesticides was already passed in March last Year.

 

If the Initiative is accepted, Switzerland's agricultural Production

will plummet and it is clear that more foreign Food Imports will be

needed. It is highly possible that the Environment and Organic

Cultivation Methods of the importing Countries deviate from the high

Swiss Standards.

 

The Federal Council (Swiss Government) and Parliament stand in

"Opposition" to the Initiative. The National Assembly's Vote

(Nationalrat) was, 81 Votes in favor (Yes), 107 Votes against (No),

and 7 Abstentions.

The Council of States' Vote (Staenderat) was, 9 Votes in favor

(Yes), 31 Votes against (No), and 4 Abstentions.

Leftist Parties, the Greens, Green Liberals and ProNatura, and

Greenpeace support the Initiative.

Centrist and Conservative Parties, the Business Community, and the

Federation of Agricultural Co-Operatives are against it.

 

2) Popular Initiative "For a Switzerland without artificial

Pesticides" *3)

 

The Use of Pesticides is permitted in Switzerland, but only Products

approved in Switzerland. They are used for Agriculture, Food

Production- and Processing etc., fighting harmful Organisms and

Pathogens, and maintaining Landscapes and Soil. The Initiative

Committee considers the Situation to be inadequate and made a

Proposal. Their Claim is to ban the Use of artificial Pesticides;

calling for a Ban on the Import of Foods containing artificial

Pesticides in Switzerland. The Transition Period will be 10 Years

until the Ban must be fully implemented.

 

The Swiss Government has already set strict Rules on the Use of

Pesticides. It also provides financial Support for Research and the

Development of Alternatives. A total Ban on Pesticides would prevent

Plants and agricultural Products from being protected against

Bacteria and Viruses. Therefore, there is a Risk of limiting Food

Supply and Diversity and adversely affecting both Consumers and

Producers. The Ban would also violate existing International Trade

Agreements. The Parliament has also recently passed legislative

Amendments targeting at reducing the Risk of Pesticides.

 

The Federal Council (Swiss Government) and Parliament stand in

"Opposition" to the Initiative.

The National Assembly's Vote (Nationalrat) was, 78 Votes in favor

(Yes), 111 Votes against (No), and 7 Abstentions.

The Council of States' Vote (Staenderat) was 9 Votes in favor

(Yes), 31 Votes against (No), and 4 Abstentions.

Leftist Parties, the Greens, Small Farmers Union, and Bio Suisse

support the Initiative.

Centrist and Conservative Parties, the Business Community, and the

Federation of Agricultural Co-Operatives are against it.

 

On "Page Three" of the Tages-Anzeiger Newspaper dated May 25, 2021,

a full-page Article entitled "What you need to know about

Agriculture (Was Sie ueber die Landwirtschaft wissen muessen)",

reported on the current State of Swiss Agriculture with a Graph.

The main Issue is "a Breakdown of direct Subsidies to Agriculture of

CHF 2.8 billion", "Breakdown of Livestock", "Agricultural chemical

Sales", "Ratio of Organic Farming", and "Food Self-sufficiency Rate".

 

The Breakdown of Subsidies is 39% for Security of Supply, maintaining

Production Capacity in the Event of Supply Bottlenecks, 19% for

Maintaining Cultivated Land, 17% for Organic Farming and animal-

friendly Production Systems, 15% for Biodiversity Conservation, as

well as 5% for Resource Efficiency, 4% for Landscape Maintenance and

1% for transitional Contributions.

 

The "Breakdown of Livestock" is based on 1975; while the Number of

Cattle and Pigs has decreased, the Number of Chicken has doubled in

2020. The total Number of Livestock in 2020 was 78% for Chicken, 11%

for Cattle and 8% for Pigs.

 

Regarding to "Agricultural Chemical Sales Volume", Organic

Pesticides increased and Chemical Pesticides decreased between 2008

and 2018.

 

The "Ratio of Organic Farming" increased by 10% from 1990 to 2020,

with 14% Increase in Cattle raised by Organic Farmers, 10% Increase

in Chicken, and 3% Increase in Pigs.

 

In this way, Swiss Agriculture seems to be making steady Progress,

albeit little by little. The actual feeling as a Consumer, Farmers

are also making Progress in Organic Farming as well as in

sustainable Agricultural Products. Introducing radical Regulations

will threaten Food Safety. I think Consumers should evaluate and

support their Labor, rather than making a Farmer a bad Guy.

 

The so-called "Agrarian-Initiatives", launched as two Public

Initiatives, are particularly controversial, seeming to be

persuasive at first Glance, but it became known that the Contents

is quite careless. It has become an uncertain Formation to get

Approval. Switzerland’s Land is disadvantageous for Food Production

and the Country has not a sufficient Self-Sufficiency Rate, securing

Food is an important Security Issue. Swiss Retail Giants Migros and

Coop have also warned that the Agrarian Initiatives will make it

difficult to secure Food.

 

3) Federal Law of 25 September 2020 on the legal Basis for

Ordinances of the Federal Council to cope with the Covid-19

Epidemic (Covid-19 Law) *5)

 

In February 2020, the Corona-Virus reached Switzerland and the

Number of severely ill People increased rapidly. Things were so

urgent that the Federal Government enacted Emergency Legislation

permitted by the Federal Constitution in the Event of a Crisis. The

Law gives the Federal Government additional Power to combat the

Corona-Virus Pandemic. However, such an Emergency Law is limited to

6 Months. The Federal Government and Parliament hastily drafted the

COVID-19 Act, which came into effect immediately in September 2020

so that necessary Measures could continue to be taken. To help People

and Businesses suffering from the economic Impact of the Pandemic,

the COVID-19 Act regulates to compensate for short-time Work

(Kurzarbeit), Compensation for Loss of Earnings, and support for

Culture, Sports and the Media.

 

The Referendum Committee has argued that the new Law was enacted in

a Hurry, bypassing the People and a Referendum was launched. The Law

includes Subsidies to Media that are perceived as harmful. The

Federal Government and Parliament have passed the COVID-19 Act in

accordance with democratic Rules to continue to support People

affected by the Pandemic as long as necessary, to maintain

Employment and to ensure the Survival of Swiss Companies. If this

Law is rejected, it will expire on September 25, 2021. From that

Date on, there will be no legal Basis for financial Support to deal

with the Crisis, and there will be lots of Uncertainties about how

Things will go.

 

The Federal Council (Swiss Government) and Parliament recommend a

"Yes" to the COVID-19 Act.

The National Assembly’s Vote (Nationalrat) was, 153 Votes in favor

(Yes), 36 Votes against (No), and 6 Abstentions.

The Council of States’ Vote (Staenderat) was 44 Votes in favor

(Yes), 0 Vote against (No), and 0 Abstention.

Middle and Leftist Parties, Labor Unions, and Trade Unions support

the Law.

Opposition comes from the EDU (Christian Conservative Party),

The largest Conservative Party, SVP declared a free Vote.

 

It is an abnormal Situation that human Beings are encountering,

therefore, first of all, a Policy to protect the Lives of the People

to the maximum is required. Voting Forecasts expect a Majority for

that Issue.

 

4) Federal Law on Greenhouse Gas Emissions Reduction on September

25, 2020 (CO2 Law)

 

Emissions of Greenhouse Gases, especially CO2, are a major Cause of

Climate Change, causing Damage to People and the Environment. Hot

Days, Droughts, Floods and Landslides are just some of the negative

Effects that have hit Switzerland in particular. As a

Countermeasure, Swiss Government and Parliament have developed a

Strategy to further reduce CO2-Emissions and have included this

Strategy in the CO2 Law.

 

The Referendum's Committee disagrees with the new Law, which they

call costly and useless, because CO2-Emissions in Switzerland are

only a Fraction (0,1%) of the World's Emissions. The new Law has

also financial Implications for the Middle Class and to small and

medium-sized Enterprises (SMEs), facing additional Taxes and

Regulations.

 

Swiss Federal Government and Parliament are confident that Climate

Change and its Consequences can be limited by the Strategies of

their Choice without imposing Penalties on People or Businesses.

This Strategy is made possible by financial Incentives and

Reimbursement for Individuals and Businesses with low CO2-Emissions,

and Investments in Climate Protection and technological Development.

It is expected that the Number of Vehicles that consume less

Gasoline and Diesel will increase on the Market. The new Law will

not only protect the Climate, but also create new Jobs and create

additional Orders for SMEs. And reduce the Dependence on foreign Oil

Companies. If the new CO2-Legislation is rejected, the negative Vote

will be responsible that Switzerland will not be able to meet its

Goal of halving Greenhouse Gas Emissions by 2030 compared to its

1990 levels. (Paris Agreement).

 

The Federal Council (Swiss Government) and Parliament recommend a

"Yes" to the CO2 Act.

The National Assembly’s Vote (Nationalrat) was, 129 Votes in favor

(Yes), 59 Votes against (No), and 8 Abstentions.

The Council of States’ Vote (Staenderat) was 33 Votes in favor

(Yes), 5 Votes against (No), and 6 Abstentions.

Centrist and Leftist Parties, the Business Community, and the Swiss

Trade Association support the Law.

Opposition comes from the SVP-Party, the EDU (Christian Conservative

Party), Home-Owners Association and the Swiss Automobile Club.

 

In short, it seems to be a Law that increases fossil Fuel Costs. It

can be said that it is the Spirit of the Time to encourage People to

use fossil Fuel in a restrained Manner that is the Government's

Policy's aim. Personally, if it helps to alleviate the Heat-Wave, I

will try not to ride a private Car or get on an Airplane as much as

possible. Even small and medium-sized Enterprises (SMEs) should

benefit from choosing environmentally friendly Management Policies

in the long run. Despite Criticism that bureaucratic Procedures will

increase, it is expected that a Majority will approve it.

 

5) Federal Act of 25 September 2020 on Police Measures to Combat

Terrorism (PMT) *7)

 

The Federal Government explained that the Threat of Terrorism has

increased since the Terrorist Attacks in Paris in 2015. Many Cantons

are strengthening Counter-Terrorism Legislation. Although

Switzerland has continued to expand its Reach in recent Years, there

are still some Gaps. To fill that Gap, Federal Government and

Parliament have created a new legal Basis that gives Police

additional Means of taking Precautions against the Threat of

Terrorism. Currently, Police can only intervene if a Person has

committed a Crime.

 

Two Committees that challenge the new Law have successfully launched

a Referendum. They believe that the new Measures will not enhance

Security. On the contrary, human Rights and Children's Rights are

violated because some Measures can be imposed on Children from 12-

year-old on. The new Law also leads to a Crisis of Separation of

Powers as it allows Police to arrange and implement Measures on the

Basis of mere Suspicion without judicial Approval, the Referendum-

Committees claim. They also emphasize the arbitrary Nature of the

Law, saying that political Activities not approved by the Government

may be defined as "Terrorist Activities."

 

In the view of the Federal Government and Parliament, the Law allows

Police to intervene in order to protect Residents only when there are

concrete and real Signs of a Terrorist Threat. House Arrest is the

last Measure and always requires Court Approval. Rule of Law, Basic

Rights and Human Rights are respected and all Measures can be

appealed to Federal Courts. The new Law complements the three-pronged

Strategy for combating Terrorism: Prevention, Repression and

Reintegration.

 

The Federal Council (Swiss Government) and Parliament recommend a

"Yes" to the PMCT Act.

The National Assembly's Vote (Nationalrat) was, 112 Votes in favor

(Yes), 84 Votes against (No), and 0 Abstention.

The Council of States' Vote (Staenderat) was 33 Votes in favor

(Yes), 11 Votes against (No), and 0 Abstention.

Centrist and Conservative Parties, EVP, and the Swiss Police

Officers Association support the Law.

Opposition comes from Leftist Parties, the Greens, GLP, Operation

Libero, Amnesty International, and the Episcopal Conference.

 

Even in Switzerland, the Reality is that Concerns about Terrorism in

the Civil Society are not other People's Affairs. Although the Law

could be operated arbitrarily in a Country with Power Leadership, the

Bill is expected to be approved because of the Confidence that the

Law will be operated properly in Switzerland.

 

[General remarks]

 

Swiss Voters have been presented five Bills that are at the Mercy

of Pros and Cons. The latest Polls of "Tamedia" *8) and "gfs.bern"

9*) informed by Tamedia and SRF showed a similar Trend. In other

Words, the two publicly-initiated "Agrarian Initiatives" are

expected to be rejected; COVID-19 Law, CO2 Act, and the Counter-

Terrorism Federal Police Act (PMCT) are expected to be approved.

[Editorial Postscript]

 

I am not in a Position to deny the Direct Democracy, but nevertheless

I think, it is a Problem that some Contents of "Popular Initiative"

are not sufficiently verified on its impact on Legislation. I think

that it should not be used as a Measure to show off the Existence of
