1. 国民発議 「覆面禁止に賛成」:*2)

 

覆面の禁止は数年前から議論されており、既にティチーノ州とザンクトガレ

ン州は顔の覆いを禁止している。他にも、15のカントンで、集会やスポーツ

イベントでの覆面は禁止されている。主にブルカやニカ等イスラム圏の女性

の覆面が禁止の対象にされている。*3)

 

発議委員会の「覆面禁止に賛成」の要旨は、公的路上、公共交通機関、商店

、レストラン、官公庁、サッカー競技場、屋外等では顔を覆ってはならず、

例外は礼拝所、聖地、健康や安全上の理由、気候条件、地域の慣習(カーニ

ヴァル)のみを許容するという内容だ。発議委員会は、女性旅行者の覆面等

の例外を認めていない。

 

発議委員会は、公共の場で顔を覆うことは、女性に対する抑圧の表れで、平

等な権利と両立せず、自由な社会で共に暮らすことと対立する。又、覆面の

禁止は、治安と犯罪との闘いにも資するとの説を展開している。

 

連邦評議会(政府)と連邦議会は、スイス全土での禁止は行き過ぎだと反対

している。根拠は、スイスでは覆面が極希な現象に過ぎない事。又、地域の

規則を制定するのは州で、地元の状況を最もよく知っている。

従って、スイス全土での禁止は、州(カントン)の権利を制限し、観光に悪

影響を及ぼし、影響を被る女性の助けにならない。

いずれにせよ現行法では、女性に顔を覆うよう強制するのは刑事犯罪と規定

されている。

 

連邦評議会と連邦議会は、連邦法のギャップを埋める為の対案を提出してい

る。その中身は、身元確認中は当局に顔を見せなければならない、女性の権

利を強化するための資金提供プログラムも規定している等。

イニシアチブが拒否された場合はこの対案が有効になる。

 

連邦評議会と連邦議会は、 イニシアチブに「反対」を推奨。

議会の評決は、国民議会が賛成77票、反対が113票、棄権が7票。

全州議会は、賛成7票、反対36票、棄権2票。

以上が連邦政府からの情報だ。

 

イスラム圏の女性の服装を対象に議論されているが、犯罪者やテロリスト、

フーリガン対策の上からも禁止すべきという視点があるにもかかわらず、

これらの事が議論で語られることは殆ど無い。

 

賛成派はSVPDer Mitteの一部に、FDPSPの少数。反対派はSVP以外の全政

党と多勢に無勢にも見えるが、議会ではかなりの割合で賛成票が見られる。

ところが、ターゲス・アンツァイガー紙が伝えたタメディア社のオンライン

世論調査では、賛成が1回目では63%、2回目では65%と賛成多数の傾向が揺

るがない。

 

昨今、10年以上遡るミナレットの建設拒否と共に、公の場での覆面が、イス

ラム教に対する猜疑心や警戒心の象徴になってきた感がある。スイスからIS

等のイスラム過激派に参加する若者達がいる事や、欧州域内で発生している

イスラム過激派によるテロ行為が、人々の警戒心を高めていることは無視出

来ない。治安上の観点からも、公道を覆面で移動することを自国で禁じるの

は、正当な措置の範囲であろう。

 

コロナ渦で我々自身が覆面をしなければならない最中に、覆面禁止を国民投

票で問うのは滑稽だと、TA紙のフィリップ・ローザー記者が、2020220

日付最新号「Das Magazine」で、「Volkswille fuer nichits (民意は無意

)」と言う表題のコラムに書いた。*4)

確かに、如何にも皮肉な事態になったものだ。

そうは言っても、白昼の覆面姿は、西欧世界はおろか日本でも不信感で受け

止められる。

砂嵐の起こる土地で暮らしている民族でも、そんな心配の無い国に来たらブ

ルカは脱いで、ホスト国の習慣に配慮するのが礼儀であろう。

イスラム圏以外の女性VIPがイスラム国を訪問する際には、頭をベールで覆

っている様に。

 

スイス政府が各カントンに判断を委ねる姿勢も、コロナ渦の対応と共に議論

を招いている。連邦制を尊重して地方自治に重きを置くのか、中央政府の権

限を強めるのか、コロナ渦の最中、連邦制や民主主義の在り方にも議論が及

んでいる。

 

2. 電子識別サービスに関する連邦法(e-ID) *5)

 

多くの商品やサービスがオンラインで販売される事が日常化している。

そのオンラインで何かを購入したい場合、ユーザー名、パスワードなどで身

分を証明する必要があるが、これまでのところ、この識別に関する特定の規

則はなく、連邦政府からのセキュリティ保証も無いので、このギャップを埋

めるために、連邦評議会と連邦議会は、電子識別サービスに関する連邦法

(BGEID)を制定した。

 

連邦評議会と連邦議会主張は、システムの技術的な実装が実際にサードパー

ティ(企業、カントン、自治体)に委ねられている場合でも、連邦政府はセ

キュリティと信頼性の唯一の保証人になっている。データ保護は通常のレベ

ル以上に強化されている。

 

個人データは、電子IDE-ID)の所有者の明示的な同意がある場合にのみ提

供され、データは識別にのみ使用できる。特定の取引に必要なデータのみが

渡され、すべてのデータがE-IDにリンクされているわけではない。

E-IDを望まない人に登録の義務は無い。以上が政府・議会の説明だ。

 

連邦議会での評決は、国民議会が賛成144票、反対が51票、棄権が2票。

全州議会は、賛成35票、反対2票、棄権8票。

この結果によって、連邦政府・政府議会は、国民投票で「賛成」を推奨して

いる。

 

この法律に反対してレフェレンダムが提起された。団体と政党の広範な連合

がレフェレンダムを開始した。

レファレンダム委員会は、連邦政府ではない第三者のIDシステム運用、つま

り民営化は受け容れない。身分証明書の発行は、国の責任を維持し、民主的

な管理下に置く必要がある。現行のパスポートやIDカードは、国のパスポー

ト事務所によってのみ発行されているように。そうでなければデータが誤用

されるリスクがある。

レフェレンダム委員会は、新法は民間プロバイダーを通じて発行される事に

よって、公式IDは商品化されることになる言う。

 

タメディア社のオンライン世論調査は、反対が1回目は47%、2回目は55%と

反対が増えた。

 

政府が保証するE-IDとは言え、利用は任意なので、差し迫った必要性が乏し

い印象は免れない。

今でも、スイスコム、ポスト、銀行は個人情報を把握しているし、私企業や

医療機関も法的制約無しに個人情報を長年利用してきた。

官制E-IDに何の意味があるのか不明で、それ以上に、人々のシステムへの安

全性と、更なる個人情報転用への疑いが払拭されていない。

いくら当局が安全性を唱えても、鵜呑みにする人は多くはない様だ。

それを助長させる要因が、コロナ渦の後は「デジタル監視社会」になる、

という不気味な情報の拡散だ。

 

今世界各国で、「デジタル監視社会」は既に現実になっていて、言論や人権

が抑圧されている。誰もが、明日は我が身と想像しても荒唐無稽とは言えな

い時代になった。一先ず様子を見た方が良さそうだ。

 

3. インドネシアとの経済連携協定 *5)

 

スイス政府・議会は20191220日、EFTA *6) と急速に発展している人口

27100万人(世界第4位)のインドネシアとの経済連携協定を承認する連邦

令を決議した。関係国との貿易を促進するために、関税を引き下げ、貿易障

壁を取り除くことを目的としている。

この協定で、 スイスは一連の協定の結果海外市場にアクセス出来るように

なる。

連邦評議会と連邦議会は、パーム油の規定を含むインドネシアとの合意は、

両国の経済に利益をもたらすだけでなく、持続可能な開発にも重要な貢献を

するとの見解だ。

インドネシアのパーム油の関税は、生産において人権と厳格な環境規制が遵

守された場合にのみ引き下げられる。この部分は世界で類を見ない条文だと

政府は胸を張る。但し、これに関連する証拠を提出する必要はある。

以上が政府・議会の目論みだ。

 

この合意に反対してレフェレンダムが提起された。

障害となっているのがパーム油の関税引き下げ計画だ。

レフェレンダム委員会は、合意に関連する持続可能性の約束はほとんど守ら

れないと懸念する。提案された統制と制裁に対する効果的な管理と制裁の選

択肢が無いのだ。

安価なパーム油の生産は、原生林の破壊につながり、インドネシアの生態系

に被害を与えている。つまり、インドネシア政府は信頼できるパートナーで

はない。そして、この安価な油は、菜種油やひまわり油、バターなどの地元

スイスの作物とも競合すると主張する。

 

評決は、国民議会が賛成119票、反対が56票、棄権が21票。

全州議会は、賛成34票、反対8票、棄権2票。

タメディア社のオンライン世論調査では、反対が1回目は39%、2回目では

44%の反対が賛成の43%を僅かながらも上回った。

 

この法律はEFTA とインドネシアとの包括的な経済連携協定に関するものだ

が、インドネシアのパーム油の問題のみがクローズアップされている。環境

問題に人々の意識が向かう中、反対派に微かな追い風が吹いているようだ。

しかし、加盟国が一旦は減少したとは言え、EUの今後の動向を見据えながら

EFTAを守り育てていく事も重要な気がする。

 

2021224日、ターゲス・アンツァイガー紙は、3度目の世論調査の結果を

報じた。*8) 見出しは、悪くすると3議案とも敗北を喫する可能性を示唆す

る、「Dem Bundesrat droht am 7. Maerz eine dreifach Niederlage(連邦

政府は37日、3敗の危機)」。

「覆面禁止に賛成」の賛成は55%、「電子識別サービスに関する連邦法

e-ID法)」に賛成は35%、で連邦政府・議会の敗北は必至で、「インドネ

シアとの経済連携協定」は賛成が44%。

これとは別に、SRFの世論調査は、やや政府に好意的な結果が出ているが、

政府系メディアなので当然と言えば当然。*9) とは言え、E-IDには同様に極

めて懐疑的。

国民投票の投票日3週間前には投票用紙が説明書(赤い小冊子)と共に地元の

役所から送られてくる。それ以後は、賛否のキャンペーンとメディアの関連

報道が一段と活発になり投票日前日まで白熱する。従って、どこで区切りを

付けて考えを纏めるか毎度苦心するのだが、投票日以降の情報も興味深いの

1. Popular initiative "Yes to a Ban on full facial Coverings": *2)

 

The Ban on Masking has been debated for several Years; the Cantons

of Ticino and St. Gallen have already banned face Coverings. In

addition, 15 Swiss Cantons have banned the Masking at Rallies and

Sporting Events. The Masks of Islamic Women such as Burqa and Niqab

are largely targeted *3)

 

The Gist of the Initiative Committee's "Yes to a Ban on full facial

Coverings" is a Switzerland-wide Ban on Masking at all Locations

that are publicly accessible; on the Street, in public Transport,

Shops, Restaurants, Government Offices, Soccer Stadiums, or

Outdoors.  The only Exceptions to the Ban on Masking are at Houses

of Prayer and other sacred Places; or for safety or health reasons,

due to the weather or if covering up is part of the local Tradition

(Carnival). The Initiative does not allow any other Exceptions, for

example for covered female Tourists.

 

The Initiative Committee argues that covering the Face in Public is

a Sign of Oppression against Women, incompatible with equal

Rights and in Opposition to living together in a free Society. The

Ban on Masks also contributes to Security and the Fight against

Crime.

 

The Federal Council (Government) and Federal Parliament are opposed

to a Switzerland-wide Ban, calling it an Overkill.

The Rationale is that Masking is a very rare Phenomenon in

Switzerland. Also, it is up to the States (Cantons) to establish

local Rules because they are most familiar with the local Situation.

Therefore, a Ban across Switzerland limits the Rights of the States

(Cantons), harms Tourism and does not help the Women affected.

In any case, the current Law stipulates that forcing Women to cover

their Faces is a criminal Offense.

 

The Federal Council and Federal Parliament have submitted an

Alternative to close the Gap in Federal Law.

The Alternative defines that People have to show their Faces to

Authorities if this is necessary for Identification. Besides, it

stipulates a funding Program to strengthen Women's Rights.

If the Initiative is rejected, this Alternative will take effect

if it is not successfully battled against it with a Referendum.

 

The Federal Council (Government) and Federal Parliament recommend a

"No" to the Initiative.

The National Parliament (Nationalrat) voted with 77 Votes in favor

(Yes), 113 Votes against (No), and 7 Abstentions.

The Council of States (Staenderat) voted with 7 Votes in favor (Yes),

36 Votes against (No), and 2 Abstentions.

That's the Information from the Federal Government.

 

Discussions were held about Islamic Women's Clothing; however, there

should be a Ban from the Viewpoint of Measures against Criminals,

Terrorists, and Hooligans, and that is nearly not mentioned in the

Discussion.

 

Proponents are the Party SVP and parts of the Party "Die Mitte", and

a few from the FDP- and SP-Party. Opponents appear to be outnumbered

with all Parties except SVP, but a significant Proportion of them

voted in favor of the Initiative at Parliament.

However, according to "Tamedia's Online Opinion Poll" reported by

Tages-Anzeiger, 63% of the Respondents approved the Initiative (Yes)

in the first Round of Poll and 65% intended to vote Yes in the second

Round of Poll.

 

Recently, along with the approval of a Ban to build new Minarets in

Switzerland, more than 10 years ago, it seems that Masking in Public

has become a Symbol of Suspicion and Vigilance against Islam. It

cannot be ignored that there are young People from Switzerland,

participating in Islamic Extremist Groups such as IS, and terrorist

Acts by Islamic Extremists in Europe have raised People's Alertness

these Days.

>From a Security Point of View, it would be a legitimate Measure to

ban the Movement on public Roads wearing Coverings.

 

While we have to mask ourselves in the Corona Pandemic, it's

ridiculous to vote about an Initiative on a Ban on Masking, Swiss

Journalist Philipp Loser wrote in a Column titled "Volkswille fuer

nichts (People's Will is meaningless)" in the latest Issue of "Das

Magazine" of Newspaper Tages-Anzeiger, as of February 20, 2020. *4)

Certainly, it is an ironic Situation.

It means, the masked Appearance in Daytime is perceived as Distrust

not only in the Western World, but also in Japan.

For People living in a Land where Sandstorms occur, it is

understandable to wear the Burqa; however, when there is no such

weather risk taking the Burqa off, and respect the Customs of the

Host Country, when coming to such a Country, would be polite.

Like a non-Islamic female VIP covering her Head with a Veil when

visiting an Islamic Country.

 

The Swiss Government's Stance of entrusting the Judgment to each

Canton is also controversial, along with the Response of the Corona-

Vortex. In the midst of the Corona-Vortex, there has been a Debate

about what the Federal System and Democracy should be whether to

respect the Federal System and emphasize local Autonomy or

strengthen the Authority of the Central Government.

 

2. Federal Act on Electronic Identification Services (e-ID Act) *5)

 

It is becoming common for many Products and Services to be sold

Online (Internet).

If you want to buy something Online (Internet), you need to prove

your Identity with a User Name, Password, etc. So far, there are no

specific Rules for this Identification, no Security Guarantee from

the Federal Government. In order to fill this Gap, the Federal

Government and Federal Parliament have enacted the Federal Law on

Electronic Identification Services (BGEID).

 

The Federal Council (Government) and Parliament claim that the

Federal States is the only Guarantor of Security and Reliability,

even if the technical Implementation of the System is actually

entrusted to third Parties (private Company, Canton, Municipality).

For the e-ID, the Data Protection Regulations are even stricter than

usual.

 

Personal Data will only be provided with the explicit Consent of the

Owner of the electronic ID (E-ID) and the Data can only be used for

Identification. The Data needed for a particular Transaction is

passed only and not all Data is linked to the E-ID. Those who do not

want an E-ID are not obliged to register.

The above is the Explanation of the Government and Parliament.

 

The Federal Verdict was 144 Votes in favor (Yes) at the National

Parliament (Nationalrat), 51 Votes against it (No), and 2

Abstentions.

The Council of States (Staenderat) voted with 35 Votes in favor

(Yes), 2 Votes against it (No), and 8 Abstentions. Based on this

Result, the Federal Government and Parliament recommend a "Yes" to

the new e-ID Act in the Referendum’s Vote.

 

The Referendum was raised in Opposition to this Law.

A broad Alliance of Organizations and Parties launched a Referendum;

the Referendum's Committee does not accept the Privatization,

meaning the Operation of these ID-Systems by third Parties. The

Issuing of Identity Documents must remain a State Responsibility and

belongs under democratic Control, as it the Case with Passports and

ID-Cards issued currently only by State Passport Offices. Otherwise,

there is a risk of Data Misuse. According to the Referendum's

Committee, the new Law will commercialize the official ID by the

issuing through private Providers.

 

According to "Tamedia's Online Opinion Poll" reported by Tages-

Anzeiger, the Opposition (No) to the new Law was at 47% in the first

Round of Poll and has increased to 55% in the second Round of Poll.

 

Even though the electronic E-ID is guaranteed (recognized) by the

Government, its Use is voluntary, so the Impression is, that there

is little urgent Need for it.

Swisscom, Post, and Banks still know personal Information, and

private Businesses and medical Institutions have used it for many

Years without legal Restrictions.

It is unclear what the Government E-ID means, and more than that,

despite creating a new Personal Database System, the Suspicion of

further Diversion of personal Information has not been dispelled.

No matter how much the Authorities advocate Safety as much as

possible, it seems that not a lot of people take it for granted.

The Factor that encourages this, is the eerie Spread of Information

during the Corona-Vortex, People are afraid, the Country will become

a "Digital Surveillance Society."

 

In many Countries around the World, a "Digital Surveillance Society"

has already become a Reality, free Speech and human Rights are being

suppressed. Tomorrow is an Era that cannot be said to be absurd even

if everyone imagines themselves. It seems better to watch the

Situation for the time being.

 

3. Economic Partnership Agreement (EPA) with Indonesia *5)

 

On December 20, 2019, the Swiss Government and Parliament passed a

Federal Decree approving the Economic Partnership Agreement (EPA)

between the EFTA-States *6) and Indonesia. Indonesia has a rapidly

growing and developing Population of approx. 271 Million People

(fourth biggest Country in the World). The EPA aims to reduce

Tariffs and remove Trade Barriers in order to promote Trade with

the Countries concerned.

The EPA will give Switzerland access to foreign Markets based on a

Result of a series of Agreements.

The Federal Council (Government) and Federal Parliament believe that

the new EPA with Indonesia, which includes the Provision of Palm

Oil, will not only benefit the Economies of both Countries, but will

also make an important Contribution to a sustainable Development.

Tariffs on Indonesian Palm Oil will only be reduced if human Rights

and strict ecological Regulations are observed in Production.

The Swiss Government is proud that this Part is unique in the World.

However, it's said that Evidence related to this Needs must be

submitted. The above is the Opinion of the Swiss Government and

Parliament.

 

A Referendum was raised in Opposition to this Agreement.

The Obstacle is the Plan to reduce Tariffs on Palm Oil.

The Referendum's Committee is concerned that the Sustainability

Commitments associated with the Agreement are hardly realizable.

There are no effective Controls- and Sanctions Options regarding to

the proposed Commitments.

The Production of cheap Palm Oil has led to the Destruction of

primeval Forests and is damaging Indonesian Ecosystems. So, the

Indonesian Government is not a reliable Partner.

The Referendum's Committee advocates that this cheap Oil also

competes with local Swiss Crops such as rapeseed Oil, Sunflower Oil

and Butter.

 

The Federal Verdict was 119 Votes in favor (Yes) at the National

Parliament (Nationalrat), 56 Votes against it (No), and 21

Abstentions.

The Council of States (Staenderat) voted 34 Votes in favor (Yes),

8 Votes against it (No), and 2 Abstentions.

According to "Tamedia's Online Opinion Poll" reported by Tages-

Anzeiger, the Opposition (No) to the EPA was at 39% in the first

Round of Poll and has increased to 44% in the second Round of Poll;

that is slightly above Figure of 43% of those in favor (Yes).

 

This Federal Decree concerns a comprehensive Economic Partnership

Agreement (EPA) between the EFTA-States and Indonesia, but only the

Issue of Indonesian Palm Oil is highlighted. It seems that there is

a slight Tailwind for the Opposition as People become more aware of

environmental Issues. However, even though the Number of EFTA-Member

States has decreased once, I feel that it is important to protect

and nurture the EFTA, while keeping an Eye on future Trends in the

EU.

 

On February 24, 2021, "Tamedia's Online Opinion Poll" by Tages-

Anzeiger reported the Results of the third Round of Poll. *8)

The Headline implied that all three Bills may be defeated at worst

Case, "Dem Bundesrat droht am 7. Maerz eine dreifache Niederlage"

(Federal Government is on the Verge of three Defeats on March 7).

There are 55% in favor (Yes) of the "Popular Initiative", "Yes to

a Ban on full facial Coverings": and 35% only in favor (Yes) of the

"Federal Act on Electronic Identification Services (e-ID Act)", and

the Defeat of the Federal Government and Parliament is inevitable.

44% agree with the "Economic Partnership Agreement (EPA) with

Indonesia".

Apart from that, the SRF-Poll has shown some more positive

Results/Trends for the Government, but it is natural because it is

a Government-affiliated Media. *9) However, People are also

extremely skeptical about the E-ID.

[Editorial Postscript]

 

Ballot Papers with the Voting Documents (red Booklet) will be sent

by the local Government Office to the Citizens (Voters) three Weeks

before the Polling Day. After that, the Pros and Cons Campaign and

media-related Coverage become more active; it is heated, until the

Day before the Voting Day. Therefore, I always struggle with, where

to put a Break and make up my Thoughts, but Information after the

Election Day is also interesting, so stay tuned for the next Issue.
