1. 移民第三世代の帰化簡素化連邦令:

政府と連邦議会に依る移民第三世代の帰化を簡素化する憲法条項。対象と

なるのは25歳以下のスイスで生まれた移民の子弟で、スイスの義務教育を5

年以上受けており、定住許可(Niederlassungsbewilligung, Permit C)を

取得している必要がある。25歳までの年齢制限は外国人が兵役義務を回避す

るのを防ぐ為。

 

ヴォー州選出社会民主党(SP)のアダ・マッラ国民議会議員が議会で提議、

国民議会の左派系全ての政党とCVP,BDP,FDPが賛成した。外国人の第三世代

はスイス国籍が無いだけで実質的にはスイス人である、というのが支持者の

主張だ。但し、市民権が自動的に付与されるものではなく、個別の申請が検

証される事を強調している。

 

スイス国民党(SVP)は議案に反対の立場で、「大量帰化」を警告している。

移民第三世代の多くは同化が不充分と主張。キリスト教民主党(CVP)の全州

議会議員の中には、カントンの権限が弱められると批判的な意見もある。

これまで帰化手続きはカントンと地方自治体の管轄であった。この法律が

施行されれば、帰化の簡素化に関しては連邦政府が決定する事になる。カ

ントンも関与する事になるが、個別の事案で見解を述べることが出来るだ

け。帰化手続きが複雑になり、申請が充分検証されなくなる懸念が持たれ

ている。*2) *3)

 

2014年度のスイスの外国人帰化率は住民1,000人当たり4人。これは欧州平均

2倍の高率であること、又住民に対する外国人の割合が20%以上と極めて高

いという事情がある。 *4) 帰化の条件はカントンや自治体によって異なる。

定住許可に関しては、10年以上スイスに滞在すると付与される。*5) スイス

人との婚姻の場合には特例があり、スイスは殆ど査証無しに比較的自由に出

入国が出来る国の一つではある。それ故スイスの様な小規模な人口の国は、

人口政策如何で短期間に固有の伝統文化、宗教等と共に人口構成が激変して

しまう可能性を孕んでいる。今日既にスイス社会は人口急増が大きな課題に

なっている。国籍の取得は、権利だけでなく責任も担う事を意味するので、

慎重な政策が求められる所以だ。

 

2. 国道・都市交通基金設立連邦令:

NAF基金を設立して道路交通事業を一元化する議案だ。国道の運用・保守・

建設と都市交通計画が主目的。既存の高速道路網の隘路も長期的にNAF基金

の資金で解消する。400kmに及ぶカントンの道路もNAF基金の枠組みで国道高

速道路網に組み込まれる。NAFの年間30億スイスフランの財源は、燃料とデ

ィーゼルの石油税、自動車税、自動車輸入税、電気自動車税、高速道路税

(ステッカー)等が充てられる。

 

主要政党SVPFDPCVP始め BDPGLPEVPが支持し、カントン、地方自治

体、経済団体、交通団体等が恩恵を受けると歓迎している。既存の財源では

賄いきれなくなっている都市交通の渋滞を解消する為の資金を確保し、交通

網の維持管理を確実にする事を目指している。反対派はSP、緑の党、スイス

交通クラブ、環境保護団体等。NAFによって年間10億スイスフラン以上の道

路建設財源が生じて建設圧力になり、連邦予算から捻出される基金が教育、

公共交通、開発援助の削減につながると主張。スイスの道路網は良く整備さ

れているという印象だが、交通渋滞を解消する為の拡幅工事やバイパス建設、

維持管理の財源不足が不安視されてきた。

 

3. 法人税改革法III

法人税の優遇策はEUOECD等の圧力で最早国際的に容認されなくなった為、

税制改革が求められていた。持ち株会社 *6) その他の複合企業は法人税の

優遇措置受けてきた。これらの企業はおよそ15万人の雇用をし、スイス連

邦、カントン、市町村の収入の大部分に貢献してきた。企業がスイス国外に

去るのを何としても防ぐ対策が求められていた。このような企業に対する従

来の優遇税制は廃止され、持ち株会社だけでなくスイス企業も利益を得る代

替税制の措置に変えられる。この議案で法人税を引き下げることになるカン

トンは短期的に税収減となる。どれ程の税収減になるかは議論の余地がある

と言われている。この税収減を補てんする為に連邦政府はカントンに年間11

億スイスフラン拠出すると決めた。

 

賛成派はSVPからGLPまでの政党、全てのカントン政府、経済団体。スイスは

企業流出を防ぐには代替措置無くして税制優遇措置を廃止する事が出来なか

ったと主張する。スイスが税制面で魅力的であり続けるなら、企業はスイス

に投資し続け、雇用を創出し、長期的な税収が増えると、肯定的な動きを展

望している。

 

スイスでレファレンダム *7) とは、政府が決定し議会が議論して決議した

議案に異論の有るグループはレファレンダム(国民投票)で賛否の民意を問う

ことが出来る。その為に必要な署名5万筆を90日以内に集めれば、有権者が

賛否の投票をする。SP、緑の党、EVP、労働組合、複数の自治体政府は、政

府・議会が決定した法人税改革法IIIを不服として、反対のレファレンダム

(国民投票)を提起した。彼らは税制改革を導入するカントンと地方自治体が

大幅な税収減となると警告。この税収減は、給付金の減額や中間所得層への

増税で補填される事は必至。何らかの対策の必要性は否定はしないものの、

税収減を抑制する新しい議案の検討を望んでいる。

 

今回の議案は3件とも政府・議会の提案によるものなので、政府・議会は賛

成を推奨している。スイス公共放送SRG による201721日付世論調査 *7)

の投票性向は次の通り。 1. 移民第三世代の帰化簡素化連邦令は賛成が66%

反対31%と承認される見通しだ。2. 国道と都市交通の基金(NAF)設立連邦令

は賛成62%、反対28%で同じく承認される形勢だ。 3. 法人税改革法IIIは賛

45%、反対44%と拮抗しているので結果は不透明だ。

 

直接民主制によって国民が政治にきめ細かく深く関与する事で、今日スイス

人が豊かな生活を築く事が出来たのは疑いの無い事実と思う。「生活と地域

を守るには、自ら考え、判断する」という姿勢がスイス人の日頃の発言や行

動から伺える。国民投票では判断が難しい議案が多いが、様々な課題を具体

的に考え決断する機会がある事は国民の視野を広げる。立場が右派か左派か

は基より、保守か革新かの議論は今や空疎でさえある。国民投票はスイスら

しさを堅持する為に欠かせない制度と思う。

最近の国民投票の結果を見ていると、民意が権力や大勢力のキャンペーンに

よって揺らいでいるように感じる。国民が意思表示を放棄すれば、権利も失

う。負の遺産を抱えたままの今日の日本の政治状況が示すように。

1. Federal Decree on the Simplified Naturalization of Third-

Generation Immigrants:

This is a Constitutional provision to simplify the naturalization

of immigrants of the third generation by the Government and Federal

Parliaments. The target are children of immigrants who are under the

age of 25 years. They must have been born in Switzerland and having

received compulsory education for at least five years in

Switzerland. Besides, they need to have a settlement permit (permit

C). The age restriction limit of up to the age of 25 years is to

prevent foreigners from bypassing the mandatory military service.

 

The national Member of Parliament from the Social Democratic Party

(SP) from the Canton of Vaud, Mrs. Ada Marra made the proposal in

parliament; all leftist groups, the parties CVP, BDP, and FDP

supported her. Supporters argue that third generation foreigners

just haven't Swiss Nationality, but are actually like Swiss. They

however emphasize that the Swiss citizenship is not automatically

granted, but each individual application is verified.

 

The party SVP is against the bill and warns about "mass

naturalization". They argues that many third generation immigrants

are not enough assimilated. Some Council of States members of the

party CVP criticized that the authority of the Canton will be

weakened. The Naturalization procedures are in the jurisdiction of

the Cantons and local municipalities so far. If the new law is

enforced, the Federal Government will make the decision regarding

to the simplified naturalization. Cantons are also involved, but

they can just express their view about each case. There are concerns

that naturalization procedures will become complicated and

applications will not be thoroughly verified . *2 *3)

 

The circumstances with regard to the rate of naturalized foreigners

in Switzerland was at four foreign persons per 1,000 Swiss residents

in 2014. That was twice as high as the European average, and the

proportion of foreigners to Swiss residents is extremely high at 20%

or more. *4) The conditions of naturalization vary depending on the

Cantons and local municipalities. Regarding to the settlement permit

*5), if you stay in Switzerland 10 years, you are granted a

settlement permit (C). There are special provisions in the case of a

marriage with a Swiss national, and Switzerland is one of the

countries where you can enter and leave relatively freely (mostly

without visa). Therefore, countries with a small population like

Switzerland facing problems with a rapidly changing composition of

the population. Switzerland must preserve its unique traditional

culture, religion and traditions with a view to its population

policy. Today, the Swiss society has already a big problem of a

rapidly increasing population. Acquiring the Swiss nationality means

not only to get rights, but also owing responsibility, that's why a

cautious policy is required.

 

2. Federal Decree on Establishing a Fund for National Roads and

Urban Traffic (NRUTF):

It is a bill to unify the road traffic infrastructure and urban

traffic funding by establishing the NAF fund. The main purpose is

to finance the costs for the operation, maintenance, and

construction of the national highways and the urban road traffic

system by the NAF-fund. The elimination of bottlenecks on the

existing national highway system can financed in the long term by

the NAF-fund too. Besides, 400 kilometers of cantonal roads shall

be transferred to the national highway road network within the scope

of the NAF-fund. The NAF-fund will be financed annually by about 3

billion Swiss Francs (CHF) coming from the petroleum surcharge tax

on fuel and diesel, tax on motor vehicles, tax on car imports- and

electric vehicles as well as from the income by the highway tax

sticker (vignette).

 

Major political parties such as the SVP, FDP, CVP, as well as the

BDP, GLP, EVP support the NAF-bill, and Cantons, local

municipalities, economic organizations, transportation organizations

also welcome it because of the awarded benefits. The aim is to

secure the funding of projects, which eliminate the  traffic jams in

the urban road traffic system; they are no longer covered by the

existing sources of finance and to ensure the maintenance of the

traffic network. The opponents of the bill are the parties SP,

Greens, the Swiss Transportation Club (VCS), environmental protection

groups, and etc. They argue that the NAF-fund will provide annually 1

billion Swiss Francs  more for the roads leading to a push of

construction work. Furthermore, funds paid to the NAF-fund have to

removed from the Federal Budget (Federal Treasury) leading to cost

cuts in the fields of in education, public transport, and development

aid. My impression is that the Swiss road network is well maintained,

but actually the lack of financial resources for widening roads and

bypass constructions for eliminating traffic congestion, and for

maintenance costs makes concerns.

 

3. Corporate Tax Reform Act III:

Swiss tax reform becomes necessary because preferential treatment

regarding to corporate tax is no longer accepted internationally

due to the pressure by the EU, OECD etc. Holding-, domicile- and

mixed companies have so far profited from that Swiss tax system;

those companies provide around 150,000 jobs and contributing a

large part to the revenues of the Swiss Confederation, Cantons and

Municipalities. Measures to prevent such companies leaving from

Switzerland were however needed at all costs. The previous

preferential tax treatment for such kind of companies will be

abolished and replaced by alternative tax policy measures from

which not only holding companies, but also Swiss companies will

benefit. Cantons, which will introduce lower corporate tax due to

that bill, will suffer from a lower tax revenue in short term. There

is an open dispute about how much the tax revenue will be reduced.

In order to compensate that tax revenue deduction, the Federal

Government has decided to contribute 1.1 billion Swiss Francs (CH)

to the Cantons annually.

 

The proponents of the new bill are the political parties from the

SVP up to the GLP, all cantonal Governments, and economic

organizations. They argue that Switzerland cannot abolish tax

incentives without alternative measures to prevent corporate

spillage. They have a positive view, if Switzerland continues to be

attractive in terms of taxation, companies continue to invest in

Switzerland, then jobs will be created and long-term tax revenues

will increase.

 

Referendum in Switzerland *7) means if a group disagrees with a bill

proposed by the Government, discussed and approved by the chambers

of parliament, it can take the referendum. Then it has to collect

50,000 signatures within 90 days; based on it the Swiss citizens

have to vote about the bill and say either Yes or No to it. The

opponents of the parties SP, Greens, EVP, labor unions, a number of

municipal Governments are dissatisfied by the corporate tax reform

III , which was decided by the Government and Parliaments. Those

groups are against the bill and took the referendum. They warn that

Cantons and Municipalities implementing that tax reform will suffer

from a significant tax revenue reduction. It is inevitable that this

reduction in tax revenue will be compensated by reducing benefits and

increasing taxes on middle income brackets. Although they do not deny

the necessity of some measures, but they want to prepare a new bill

with less reductions in tax revenue.

 

All of three proposals are based on the introduction from the

Government and Parliaments, therefore they recommend to vote yes.

According to the public opinion survey by the Swiss public

broadcasting TV-station SRG on February 1, 2017 *7), the propensity

to vote is as follows. 1. Federal Decree on the Simplified

Naturalization of Third-Generation Immigrants is expected to be

approved by 66% Yes and 31% No. 2. Federal Decree on Establishing a

Fund for National Roads and Urban Traffic (NRUTF) is likewise

expected to be approved by 62% Yes and 28%. No. 3. Corporate Tax

Reform Act III is still uncertain by antagonized 45% Yes and 44% No.

 

There is no doubt that Switzerland was able to build up a wealthy

living today by the direct democracy and that the people are deeply

involved in politics. "To think and judge themselves to protect

their lives and community" that can be seen from the daily remarks

and actions of the Swiss. Although many bills are difficult to judge

in a popular vote, having opportunities to make concrete decisions

on various matters will broaden the public's view. Considering

positions only regarding to right-wing or left-wing, or conservative

or radical is even poor in substance now. I however think that

popular votes are an indispensable system to maintain the adherence

to Swissness.

Editor's Comment

 

Looking at the results of recent popular votes, public opinion seems

to be shaking by the campaign of political power and major hands. If

the people abandon their declaration of intention, the right will

also be lost. As it's shown by today's Japanese political situation

with a negative legacy.
