各議案の「政府と議会」の推奨投票を「説明書」*1) で見て見た。 １．「別荘」の発議は、「反対」を推奨。 ２．「建設費節減」発議は、「推奨無し」（これは珍しい）。 ３．「誰にも６週間の休暇」発議は、「反対」を推奨。 ４．「マネーゲーム」連邦法は、「賛成」を推奨。 ５．「書籍再販売価格維持」連邦法は、「賛成」を推奨。 以上の箇条書きを一見しただけでは良く分からない。やはり事の経緯と背 景をそれなりに知らなければ賛否の判断が出来ない事を確認した。 １．「岸辺を無くす程の別荘建設は終わりにしよう」は、84歳の政治活動 家フランツ・ウェーバー氏の発議だ。通称ウェーバー発議と呼ばれている 要点は、各自治体の別荘を20%を上限とする規制を憲法に明記しようという 議案だ。2012年3月3日付ターゲス・アンツァイガー紙は、これに否定的な 論拠を報じた。地方の特性を考慮せずに、全国一律の規制をかける事は地 域経済を阻害する事になりかねない。人口が減り続ける自治体は別荘が無 ければ存亡の危機に瀕するという事情もある。そもそも「本宅」と「別荘」 をどのように定義するかも問われている。定年退職している数件の隣家は 頻繁に「本宅」を留守にして専ら「別荘」で過ごしている。本宅よりも別 荘の方が大きい家庭もある。スイス人のライフスタイルは多様だし、別荘 を持っている事は特別の事でも無い。この発議一利あるものの、内容が硬 直的で配慮に欠けた議案と言う評価に頷かざるを得ない。ウェーバー氏の 唱える問題の解決策としては、2011年に既に発効している対案「土地利用 法」がより良い解決策であると言われている。 ２．スイスは諸外国に比べて持家比率が低い事から、バーゼル・ラントゥ 半州に倣って、持家の税控除を増やすよう憲法の修正を求めた議案だ。省 エネ仕様には年5,000スイスフランの税額控除も求めている。FDPが発議し 、SVP、BDP、CVPの保守中道政党が賛成している。反対派の意見は、そもそ も持家を持てるのは平均以上の収入のある家庭に限られるので、借家住ま いの家庭と不公平が生じる。又、3本立ての年金制度の2本目と3本目の柱で 持家に税の特典があるいるので、これ以上の措置は必要無しと、連邦政府、 州政府、SP、緑の党、グリーン・リヴェラル、借家人協会等が反対してい る。住宅投資は経済の波及効果が広範囲で著しいと言われているので、政 府が内需拡大の振興を目指すなら有効かもしれない。もっとも今や殆どの 州政府は財政難なので、行政は税収減を恐れているようだ。ターゲス・ア ンツァイガー紙の3月初めのオンライン世論調査では、賛成が先月55%だっ たのが、現在49%と過半数を割り込んでいる。 ３．*2) 年間の有給休暇は現行法では最低4週間だが、平均は5週間になっ ているそうだ。労働組合連合 <Travailsuisse> の発議の動機は、労働環境 の厳しさが増す中、着実に効果的に成果を上るには6週間の休暇が必要だと いうもの。過労に依って企業と社会にかかる負担は100億スイスフラン（1兆 円規模）にもなるが、国内経済に影響する費用は確実にこれよりも少ない、 と発議は主張している。これに対して、政府、保守政党、経済界は、今以上 に労働コストを上げれば国際競争力を削ぐと反対の大合唱。特に中小企業は 人員の遣り繰りが出来ず持ち堪えられなくなると主張。上記TA紙の世論調査 では反対が8ポイント増えて63%になっていて望み薄だ。「休暇が増えると雇 用が減る」というキャンペーンが目立っている。スイス経済の将来も不確か な状況に直面している事情を、国民も肌身に感じているようだ。 ４．ロッタリー・スポーツ賭博・カジノは連邦政府と州政府が許認可を行い 、収益金が文化事業、スポーツ行事、社会福祉目的、更には国民年金と障害 者年金等の社会事業にも行き亘るよう現行憲法に記されている。今回の議案 は連邦評議員・議会が、2009年に発議されたイニシアティブの対案として 2011年9月29日両院で議決されたもので、この間イニシアティブは発議を取 り止めている。今日インターネットも含めて各種賭博が盛んになっている事 から、それらを野放しにせず行政の監視下に置き、収益金も憲法に定められ ている通り適正に配分するという規定を徹底させる内容のようだ。主要政党 がこぞって賛成している。最早論争は収束した議案の様だ。 ５．本の価格は、2007年までドイツ語圏では出版社と書店の間で定価販売す る協定が定められていた。フランス語圏では90年代初めに自由化され、イタ リア語圏では常に自由だった。2004年に連邦議会が全国一律の制度にすべし と発議案を提出して議論の出発点になったという経緯がある。今回の議案「 書籍再販売価格維持」は文化財としての本の価値を守ろうとする意志による ものだ。量販店の安値競争からスイスの作家、中小の出版社や書店を守らな ければならないという危機意識がある。反対論者は、スイス国内の本の価格 は諸外国に比べて高額なので、外国で本を買う傾向に拍車をかけると反論し ている。又輸入書籍については、80%の輸入図書を扱う外国の大手出版社が 専ら恩恵を蒙る事になるとも主張している。ミグロの書店<Ex Libris>がス イス市場を守ってくれるという意見があるが、寡占体制を容認する事になっ て市場の魅力が失われるように思う。議案でE-Book は対象外になっていて、 外国のオンラインショップに利する事になるという懸念も根強い。中立国で 直接民主制 *3) のスイスの報道は諸外国に比べて公正だという印象を得て いる。すべてを市場原理に委ねない事が、言論の自由と文化を守る事だと思 う。書籍にお金をかけられない人には図書館がある。 スイスでは国民が発議できる直接民主制によって、国民と立法・行政府との 綱引きが恒常的に行われているわけだが、これまでのところメディアは国民 の側により肩入れをして来たように思える。メディアも国民も政治家に対し ては遠慮せずかなり辛辣だが公平でもある。だが、最近、保守派の政治家に よるドイツ語有力紙への資本参加が明るみに出る等して、注意深く観察すべ き事情が出てきた。貧しく厳しい生活経験を経て来た世代は徐々に減り、豊 かな時代しか知らない世代が主流になって来た。更に、外国人も恒常的に増 えており、社会の共通認識も一層議論が求められるようになって来た。アイ デンティティーを守ろうと孤軍奮闘するスイスの姿を国民投票に見る気がす る。 【 参照 】 *1) 2012年3月11日国民投票政府の解説： http://www.bk.admin.ch/aktuell/abstimmung/va/002/index.html?lang=de http://www.admin.ch/ www.parlament.ch www.ch.ch *2) http://www.ferieninitiative.ch/ www.ferieninitiative-nein.ch *3) 直接民主制：http://ja.wikipedia.org/wiki/%E7%9B%B4%E6%8E%A5%E6 %B0%91%E4%B8%BB%E5%88%B6 【 編集後記 】 結果もさることながら、議案の内容を理解しようと思って纏めている。今 回の発行も投票日直前になってしまったが、投票結果を見てからでは理解 は自ずと異なってしまうだろう。3月11日は国民投票日と東日本大震災、福 島第一原発事故の1年目が重なった。様々な思いが錯綜する中、国民が政治 を考える事の重みを一層実感している。

I have looked at the recommended ballots of each bill by the government and the parliament at the "Explanation leaflet" *1). 1. "The secondary residence" initiative is recommended with "No". 2. "The Building-savings" initiative wasn't recommended (quite rare). 3. "Six weeks holiday for everybody" initiative is recommended with "No". 4. "Money games" [Federal Law] is recommended with "Yes". 5. "Resale-price maintenance for books" [Federal Law] is recommended with "Yes". It's not easy to understand only by looking at the above bullet points. I confirmed that you should know a certain history and background of each bill, otherwise it's not possible to judge "yes" or "no". 1. "Let's stop to construct shore less secondary residences" is initiated by the 84 years old political activist Franz Weber. The point of the so called <Weber initiative> is to fix in the constitution a restricted number of secondary residences in each local commune at a level of 20%. Tages-Anzeiger dated March 3,2012 reported negative arguments about the bill. Uniform regulations throughout the country without considering local attributions could spoil the local economy. Local municipalities with decreasing population might be confronted with a fateful crisis without secondary residences. Actually it is questioned about the definition between main residence and secondary residence. Some retired neighbors are often away and stay in the secondary residence. Even a family can have a bigger secondary residence than the main residence. The life style of Swiss people is diversified and to have a secondary residence is often not a special case. The initiative sounds logical, however, I have to nod the evaluation of the rigid contents and lack of sensitivity. A solution of Mr. Weber's problem, it's said that already effected counterproposals implemented in the revised <land use planning law> are better. 2. The Housing ownership rate in Switzerland is lower compared to other nations; following rules of the <Canton Baselland>, the bill is to claim an amendment of the constitution, increasing tax cuts for one's own house. The initiative claims CHF 5,000 tax reduction for energy saving measures, so-called <energy building-savings>. The FDP-party took the initiative, and conservative political parties of SVP, BDP and CVP supported it. The opinion of the opposition is that house owners should be above the average income of a household, therefore, it is considered unfair compared to those living in a leased house. Furthermore, the second and the third pension scheme among the three column system allow already tax privilege for owners of houses, therefore, no more measures are necessary. The opposition comes from the Federal Government, Cantonal Government, the parties SP, Green, Green-Liberal, and the association of tenants. It's said that a housing investment brings a wide and significant spillover effect for the economy. If the government wishes to promote domestic demand, the initiative could be effective. Anyway, nowadays many cantons are in a fiscal pinch; public administrations had to be afraid of less tax income. The Online questionnaire of Tages-Anzeiger of beginning of March showed that (Yes) support ratio of previous month was 55%, but presently less than majority with 49%. 3. *2) The minimum annual holiday is four weeks by the present law and the average annual holiday is five weeks. The motivation of the initiative by the labor union federation <Travail Suisse> is that working environment is becoming harder, therefore, in order to be able to work steadily and effectively, working people need six week's holiday. The initiative appeals that overwork burden to the companies and society would cost SFr. 10 billion (one trillion yen level), but the cost to the domestic economy should certainly be less. Whereas the government, conservative political parties, and business world rose a chorus of opposing that if the labor cost will be risen, international competitiveness would be lost. Especially small and medium-sized enterprises could no longer exist due to tight personnel management. According to the aforementioned questionnaire of <TA>, the situation seems hopeless now, the opposition to the initiative has increased to 63% a plus of 8 points. The campaign "more holidays less job" is noticeable. People are also aware of the situation that even the Swiss economy is facing an uncertain future. 4. The present constitution regulates that the Federal Government and Cantonal Government grant permission to Lottery, Sports gambling, and Casino. Those profits should be allocated to cultural programs, sports events, social welfare purpose, as well as social institutions such as AHV (National Pension Plan) and IV (Disability Pension). The bill was decided at the parliaments on September 29, 2011 as the counter proposal against an initiative launched in 2009, and in the meantime the initiative committee has withdrawn the initiative. The aim of this bill is that at present-day many kind of gambles, as well as through internet, are popular, therefore, those should be put thoroughly under the administrative control and allocate profits appropriately according to the constitution. Major political parties' have ganged up to support the bill. The argument of the bill seems to be converged. 5. The resale-price for books was contractually stipulated between the different parties up to the year 2007 in the German part of Switzerland. In French part, the liberalizing of the <book-price> started in the beginning of the 90's, and in the Italian part, it was always free. The Federal Parliament took the initiative in 2004 that <book prices> should be under a uniform regulation throughout the country. The bill of this time "Resale-price maintenance for books" has the will to protect the book as a cultural heritage. There is the crisis consciousness that Swiss authors, small-and- medium-sized publishers, and book shops should be protected from price competition by mass retailers. The opposition argues that book prices in Switzerland are higher than in other countries, therefore, the measure drives people to buy books in foreign countries. Furthermore, more than 80% of imported books are handled by foreign leading publishers; those will mainly take advantage. There is a remark that <Ex Libris> of Migros bookshop would protect the Swiss market, but I think to accept a oligopolistic system by <Ex Libris> could spoil the Swiss market attractiveness. The <E-Book> is excluded in the bill; people are concerned that foreign online shops would take advantage. I have an impression that Swiss freedom of press in the nation of neutrality and direct democracy *3) is fair compared to other countries. Not everything should be possible by market principles; freedom of the press and culture is to be protected. There are libraries for the people who cannot afford to pay a lot for book. In Switzerland, thanks to the direct democracy, people can initiate; the tug-of-war between people (citizens) and legislative/executive are carrying on permanently, and so far I got an impression that media support more people. Media and people are candid and even have a sharp tongue, but also fair for politicians. However, recently an incident was discovered that a conservative politician participated on one of the major German newspapers; the situation has made clear that we have to watch carefully. The generation experienced poor and hard life has gradually decreased, and a generation knowing only an era of abundance become the majority. Furthermore, foreigner have constantly increased; social common understanding is needed with more discussion. This time again the release day of journal is just before the polling day, but after watching the results, my understanding might become different. The 11th of March, 2012 is coincidentally the same day of the national voting and one year after the <Great East Japan Earthquake> and the nuclear accident of the <Fukushima- Daiichi>. Many thoughts have come up into my mind, and I feel more importance for the people to think about politics.
