次に予定されている国民投票は2006年9月24日で、議案は3つ。
一つ目は、「国立銀行の収益を国民年金(AHV)の基金に充てよ」という国民発議(イニシアティヴ)。今回の発議にスイス国民党(SVP)は加わらなかったが、社会党(SP)の元連邦評議員ルートゥ・ドゥライフース女史が旗振り役になって、通称「コーザ・イニシアティヴ」と呼ばれる委員会が執念で国民投票を実現させた。スイスの人口構成が典型的な高齢化社会なのはご承知の通りで、今後AHVには益々莫大な資金が必要になるについて、切実な危機感から発議された。今回の提案の内容は、昨年実施された分配方法ではなく、この金を今後は連邦政府には渡さず、州政府へのこれまでの割り当て分も減らして年10億スイスフランとし、残りはAHVに注入すべし、という主張だ。因みに昨年の連邦政府の割当分はAHVの赤字の穴埋めに使われた。国民発議委員会は、国立銀行の金はそもそも国民の資産だという見解だ。

当然の事ながら、連邦政府、州政府はもとより、議会、経済界、そして今では右派政党も加わって反対の大合唱。賛成派は左派政党、労働組合、緑の党関係で、賛否の二極化が際立つ。経済界の言い分は国立銀行の独立性が損なわれる恐れがあり、しいてはスイスフランの国際的な信用にも影響すると反対する。減らす分連邦税・州税の増税に繋がるとの懸念も根強い。他方、若者達は教育や文化振興に公的資金をもっと注入すべきだと主張する。だが、年金生活者は受取った年金を消費するので内需拡大の牽引力になるだろうし、ならば税収にも寄与することにもなり、高齢になって貧窮する心配が無ければ社会の安定にも資するとは思う。この議案もこれ迄延々と繰広げられてきた国民、連邦政府、州政府三つ巴の分捕り合戦だが、直接民主制では国民の声が最優先される。増してやこの提案は人口構成では有利な高齢者の利益に関わるものなので、案外通ってしまうかもしれない。国民の決定が注目される。

二つ目の外国人法と三つ目の難民収容法の修正案はいずれも政府と議会の提案だ。要点は、EUとEFTA以外の地域から来ている外国人は、高度な職能を有する労働者に限り、しかも基本的にスイス国内にのみ住む事が義務付けられる。例外は投資家、著名人、学生、人身売買の犠牲者等。滞在許可を得ている外国人は、新たにスイス国内のどこでも働くことが許される一方で、スイス社会に充分順応している事が求められ、認められれば5年の滞在許可が与えられるという内容だ。これが通れば、現在よりもはるかに厳しい法律となるそうだ。

夥しい情報の中で象徴的な事例が目をひいた。結婚3年に満たない外国人女性のスイス人の夫が事故で亡くなった。2歳の幼子を抱える寡婦に滞在許可が与えられるかどうか?当局は検討中と言う。他の顕著なケースでは、生涯の大半をスイスで暮らし、納税しスイスの発展に貢献して来た外国人は珍しくない。その子女はスイスで教育を受け、中身はすっかりスイス人。その親達も長年の外国暮らしの後故郷で暮すには、心理的な距離感は少なくないと予想される。それは長く外国に暮らしているスイス人にも同様の心理はあるという。人々が益々国境を意識しないで生きていく時代に向っているのは確か。

賛成は連邦政府、右派と市民政党、経済界。スイス産業が国際競争力を維持するには、先端技術を担う国外からの優秀な労働力の確保は欠かせない、という経済界の言い分に一定の配慮を講じた議案と言えよう。他方、人間の尊厳は国籍によるものであってはならないという人権派、緑の党、左派政党、労働組合に加えて教会がこの議案に反対している。だが、スイス人の労働市場確保に不安がある昨今、外国から来ている季節労働者でも、スイスでせっせと稼いで、故国に豪邸を建てたりしているケースがままあって、スイス人の感情を刺激しているのも事実だ。

難民法の修正案は現状よりも一段と厳しいもので、必要書類を持たない難民を支援した者や雇い主は禁固刑にさえする場合がある、と言う内容には一般国民にもやや行き過ぎという見方がある。経済難民の犯罪率は高く、刑務所の維持費は年々増す一方という現状に当局が手を焼いての法案化だ。欧州では植民地時代の負の遺産が原因で、雪崩の様に押し寄せる難民に手を焼いている政府は少なくない。法律は厳しくしても必ず抜け道を見つけ出す者がいるので、実効が上がるかどうか疑わしい、という醒めた意見もある。政府関係者からは、難民を受け入れる代わりに、難民流出国の開発支援を積極的にすべきだという意見も聞かれる。正論ではあろうが、未だに世界各地で紛争が頻発している現状を思うと、痛し痒しといった面がある。今回の議案の判断も容易ではない。日々メディアで賛否の宣伝合戦が激化している。どのように投票するか、ギリギリまで考えることになりそうだ。

毎度の事ながら、溢れる情報の中に埋もれて国民投票の賛否を決めるのは一仕事。
だが学ぶ事も少なくない。スイスの国益に資する判断をしたいと思う。(A.H.)

The next national vote is going to take place on
September 24, 2006 regarding to three bills. The first one is a citizen's initiative, and it demands that profits of the Swiss National Bank (SNB) should be transferred to the national pension fund (AHV). This time the Swiss People's Party (SVP) didn't join the initiative committee, however, Ms. Ruth Dreifuss, ex-SP Federal Councilor, plays the roll of flags-person for the so called <Kosa Initiative>. The committee initiated the national vote with their strong will and effort. You might have known that the Swiss demographic composition is that of a typical aging society, therefore, AHV needs increasingly a huge amount of money in the future. The initiative was proposed based on a compelling sense of emergency. The content of the initiative does not want to allocate SNB profits like the previous year. The committee requests no allotment to the Federal Government, cutting down the portion for the prefecture governments to just one billion Swiss Francs, and the rest should be poured to AHV. Actually, the allotment to the Federal Government last year went to AHV. Anyway, the idea of the initiative committee is that originally the money of the Swiss National Bank belongs to people (citizens).

The Federal Government and the prefecture governments too, as well as the parliament and business circles have joined now the right wing parties making chorus against the initiative. Left wing parties, labor unions and groups of the green party support the pro initiative side. The pros and cons of the initiative are up to polarization. Business circles say that the initiative would endanger the independency of the SNB; furthermore, the measure would have a negative influence on the international credibility in the Swiss Franc. Many of the opponents are deeply concerned about Federal and prefectures tax increases due to the cutting of the allotment. On the other hand, young people demand more public funding to education and culture promotion. Anyway, pensioners would spend the allowance, and that leads to domestic growth, and that contributes finally to the tax income. When people reach the advanced age and need to have no fear of poverty that brings social stability. This initiative is also a three-way struggle over the allotment among the nation, Federal Government and prefecture governments. Anyway, in a direct democracy, people's voice basically has first priority. Even more, the initiative concern is to benefit to the elderly people those who are at the advance of the demographic composition; the initiative might surprisingly be accepted. Let's see the decision of the people.

The second vote is about the law of foreigners and the third one regarding to the
amendment of the Asylum law; the Government and the Parliament passed both. The major point of the second bill is that foreigners coming from the outside of the EU and EFTA countries should be highly qualified workers; basically only those are allowed to live in
Switzerland. Exceptions are investors, prominent figures, students and victims of human trafficking. Foreigners having been granted the right of residency, would be allowed to work everywhere in Switzerland. On the other hand, they are requested to integrate well in the Swiss society. When admitted, they will be granted the right of residency for 5 years. If the bill was accepted, it is said that the law would be much stricter than at present.

Among lots of information, one symbolic case drew my attention. A Swiss man died by accident. His wife is a foreign national and their marriage life has lasted less than three years; they have a two years old child. Would it be the woman's right of residency continued or not? The authorities say that the case is under examination. The other noticeable case is that foreign citizens live the better part of their lifetime in
Switzerland, pay tax and contribute to the development of Switzerland; that is not rare. Their children are educated in Switzerland, so their mentality is obviously Swiss. It is said that a mental gap has been built up by their parents to go back to their home countries after such a long absence. I learned that Swiss citizens having lived long abroad have the same feeling. Now, we certainly live towards a borderless era.

The pro bill group consists of the Federal Government, right wing and civic parties, and business circles. To maintain the international competitiveness of the Swiss industry, recruiting highly qualified workers from abroad, with advanced technology knowledge, is essential, says business circles. The draft bill might have given a certain consideration to the demand of business circles. On the other hand, human-right groups, green parties, leftwing parties, labor unions and churches are in opposition to the bill because human dignity should not depend on nationality. However, nowadays the Swiss labor market is instable, so a particular phenomenon quickens the mind of Swiss people. For instance, foreign seasonal labors work hard in
Switzerland, and then they build
mansions in their home countries; that is not unusual.

The proposed amendment of the Asylum law is much stricter than the present one. Supporters or employers who support asylum applicants without documents will be even sentenced to imprisonment. Even part of the public considers that contents as rather excessive. The criminal rate of economic refugees is high, and the maintenance cost of prisons has increased year by year; the authorities are unable to control the situation proposing the present bill. In
Europe, because of the negative heritage of the colonial time, many countries are in trouble with the asylum avalanche. There is also a calm and collected opinion that there is always a loophole in a strict law, so it's doubtful whether the new bill will be effective or not. Among government authorities, there is an idea to strengthen the development aid to countries of the refugee's origin instead of accepting refugees here. This argument is sound, however, considering the present situation that conflicts arise in many parts of the world, it's a mixed blessing. This time, the decision making regarding to the vote is again not easy. Campaigns of both side pros and cons of the bills are getting more active day by day. How to make up my mind, I have to wait till the last moment.

As usual, the decision making about a national vote, buried in material, is a challenge for me. But, I can learn a lot from this process. I wish I could judge how to contribute to the Swiss national interest.

La prochaine votation populaire aura lieu le 24 septembre 2006. Les trois objets en votation sont: Le premier concerne: une initiative populaire intitulée: "Bénéfices de la Banque Nationale (BNS) pour l’AVS". Cette initiative demande que le profit de la Banque Nationale Suisse soit transféré au fonds de pension  (AVS). Cette fois, l’UDC (Union démocratique du Centre) n’a pas rejoint le comité d’initiative. Mais par contre Mme Ruth Dreifuss, ancienne conseillère fédérale, parti socialiste, a joué le rôle de porte-drapeau concernant cette initiative appelée « Cosa ». Le comité a lancé cette initiative après beaucoup d’efforts et de volonté. Comme vous le savez la population de la Suisse devient de plus en plus âgée. Dans le futur notre fonds de pension national (AVS) aura besoin de toujours plus de capitaux. Cette initiative a été proposée en fonction d’une situation d’urgence incontestable. Le comité demande qu’aucune part ne soit versée au Gouvernement fédéral et demande à la BNS de continuer à verser la part annuelle de 1 milliard de francs suisses qu’elle donne déjà aux cantons. Le reste du bénéfice devra être versé à l’AVS. L’idée du comité d’initiative est de démontrer que l’argent de la Banque Nationale Suisse appartient au peuple (aux citoyens).

 

Le gouvernement fédéral et les gouvernements cantonaux ainsi que le parlement et la classe économique ont rejoint les partis de droite pour s’allier ensemble contre cette initiative. Les partis de gauche, le parti du travail ainsi que les Verts soutiennent cette initiative. La classe économique prétend que cette initiative pourrait menacer l’indépendance de la BNS et plus encore, ces mesures auraient une influence négative sur la crédibilité internationale de notre monnaie. Plusieurs opposants pensent que si l’on réduit la distribution des parts, les impôts fédéraux et cantonaux pourraient augmenter. D’un autre côté, les jeunes demandent que plus de fonds publics soient alloués à l’éducation et la culture. De toute façon, les retraités dépensent leurs rentes et de cette façon la croissance nationale augmente et finalement cela contribue à une augmentation des impôts. Le peuple avance en âge, il n’a plus besoin d’avoir peur de la pauvreté tout ça contribue à la stabilité sociale. Cette initiative est une lutte de la part de 3 fronts: la nation, le gouvernement fédéral et les cantons. Mais dans une démocratie directe la voix du peuple a le dernier mot. Plus encore cette initiative concerne les personnes âgées celles qui ont été les instigateurs de notre démocratie. Cette initiative pourrait étonnamment être acceptée. Voyons ce que le peuple décidera

 

Le deuxième et le troisième objets concernent: La loi sur les étrangers ainsi que la modification de la loi sur l’asile. Les deux ont été approuvées par le Conseil national. La loi sur les étrangers s’applique aux ressortissants des Etats non membres de l’UE ou de l’AELE et demande que les travailleurs qui voudraient venir en Suisse aient des qualifications professionnelles particulières. Seulement ceux-ci auront le droit de vivre en Suisse. Les dérogations à cette loi seront: les investisseurs et chefs d’entreprise, personnalités reconnues, étudiants et personnes apatrides. Les étrangers qui ont obtenus le droit de résidence pourront travailler partout en Suisse mais ils auront le devoir de bien s’intégrer à notre société. Une fois admis, ils obtiendront le droit de résidence pour une durée de 5 ans. Si cette loi ait accepté, elle sera beaucoup plus stricte que celle actuellement en vigueur.

 

Parmi toute la multitude d’informations que nous avons reçues, une a attiré toute mon attention. C’est celle d’un couple multiculturel. Monsieur est mort récemment dans un accident. Madame est de nationalité étrangère, mariée depuis moins de 3 ans et ensemble ils ont eu un enfant âgé aujourd’hui de 2 ans. D’après la nouvelle loi, Madame n’aurait plus le droit de rester en Suisse car elle réside en Suisse depuis moins de 5 ans et ceci malgré qu’elle soit Suisse par mariage. Ce cas est particulier et il est à l’examen. D’autres cas sensibles sont ceux des citoyens étrangers qui vivent, paient et contribuent au développement et à la construction de la Suisse et qui passent la meilleure partie de leur vie ici en Suisse. Leurs enfants ont été éduqués en Suisse et la mentalité de ceux-ci est manifestement suisse. On dit qu’après une si longue absence de leur pays d’origine un vide mental s’accumule et veulent retourner à leurs origines.  J’ai également entendu cette réflexion de citoyens suisses qui avaient vécu longtemps à l’étranger. Il est certain qu’à l’époque nous vivons le monde n’a plus frontière.

 

Le milieu qui soutient ce projet de loi est: le gouvernement fédéral, la droite, le parti du centre et la classe économique. La classe économique prétend que pour maintenir en Suisse une compétitivité internationale dans l’industrie il est essentiel de recruter à l’étranger des travailleurs hautement qualifiés possédant des connaissances technologiques avancées. Par contre, les opposants (défenseurs des droits de l’homme, la gauche, les Verts, les travailleurs et les églises) ne sont pas d’accord car ils disent que la dignité humaine ne dépend pas de la nationalité. Cependant de nos jours, le marché du travail en Suisse est instable, c’est ce qui rend plus vulnérable l’opinion des Suisses. Par exemple, les saisonniers étrangers dans la construction travaillent très dur ici en Suisse pour pouvoir se construisent dans leur pays d’origine de petits châteaux ; ces cas ne sont pas rares.

 

La loi modifiée sur l’asile sera beaucoup plus sévère que celle actuellement en vigueur. Partisans et employeurs qui soutiendront les demandeurs d’asile non détenteurs de documents valables pourront être passibles de peines d’emprisonnement. Certaines personnes pensent que le contenu de cette loi est un peu excessif. Le taux de criminalité des réfugiés économiques est élevé et le coût d’entretien des prisons augmente chaque année. Les autorités sont incapables de contrôler la situation que présente la loi actuelle. En Europe à cause de l’héritage négatif du temps des colonies, plusieurs pays ont des problèmes pour résoudre cette avalanche de réfugiés qui leur arrivent. On pense également que dans toute loi stricte il peut y avoir des failles alors je doute que cette nouvelle loi soit efficace ou non. Parmi les autorités gouvernementales, on pense qu’il serait préférable d’apporter une aide aux pays d’où ces réfugiés viennent plutôt que de les accepter ici en Suisse. Cependant considérant la présente situation mondiale beaucoup de conflits surgissent d’un peu partout, cet argument semble avoir du bon et du mauvais. Cette fois encore il est difficile de décider. Chaque jour la campagne menée par les opposants et par les partisans s’intensifie. Comment faire son choix, je vais attendre jusqu’au dernier moment.
