現代では余り言わないようだが、日本には昔「一寸の虫にも五分の魂」という表現があった。名も無い庶民や力の弱い者が心意気や主張を訴える時に言ったようだ。この表現は民主主義の拠って来るところを言い得ているのではないかと気づいた。日本ではこの数年憲法論議がにわかに活発になってきて、政府・与党はじめ野党各党も草案を検討し始めていると聞く。日々の暮らしに忙しい庶民にとって、専門知識を持たずに自己主張をする事の難しさに改めて思い至るきっかけとなったのが、28日(日曜日)にスイスで今年度最初に実施されるReferendumレフェレンドゥム=国民投票請求)に対する国民投票Initiative (イニシアティブ=国民発議)に対する国民投票に関する報道だった。

 

今回の議案は3つ。議案1はアウトバーンの建設を求める「アヴァンティ(前進)−国民発議委員会(スイス・ツーリング・クラブ)」の提案に対して<アヴァンティ対案>と呼ばれる政府対案の是非を問うReferendum。議案2は、スイス借家人連盟の」発議<公正な家賃を認めろ>が2003年の国民投票で否決されたことから、政府の間接的修正案の是非を問うReferendum。議案3は<終身禁固刑>を求める国民発議委員会のInitiative(新規の国民発議)で、極めて危険で適切な治療方法の無い性的・暴力的犯罪者に終生仮釈放を認めないというもの。1月の2週目に入ってからメディアでも国民投票についてぼつぼつ報道され始めたので、周囲の人々に意見を聞いてみたが、筆者同様未だ事情を良く呑み込んでいないので答えられないと言う返事が多く、投票用紙が配布されるまでは一般の国民が見解を持つには至らないようだ。

 

3つの議案の中でも特に、「治療不可能で、極めて危険な犯罪者に対する仮釈放なき終身刑」を求めるInitiativeは、国民の大変に重い責任を痛感させられるもののように感じた。別に反対する理由はなさそうだと当初安易に思っていた自分の認識が、報道を読みながら強く戒められた気がする。主要紙の論評はこの発議を明確に否定する論調で、政府と議会も反対の立場を明らかにしている。提案した発議委員会には政党や大きな組織が支援していなかったのだが、これは客観的な検証を経ていないという見方がされるようだ。郵便投票方式が定着してきた昨今、投票所の前で署名を集めるのが極めて困難な状況にも関わらず、例外的に20万人の署名を集めて発議されたという異例の背景がある。政府は国民発議を受けて現行憲法の不足部分について法律の修正案を国民に提示しており、今回の国民投票では、実質的に政府の修正案の是非を問うものになりそうだ。いずれにしても現実的な問題意識から発議を行う国民と、法制を基に考える政府や専門家との溝は埋めきれない部分が残るようだ。

 

スイスの国民投票はInitiativeとReferendumのいずれかによって実施されるという固有の制度があるので簡単に説明しよう。先ずInitiativeについて、国民発議を志した人々が定められた数10万人の署名を定められた期間18ヶ月以内に集め、法的審査を受ける。一方Referendumには2種類あって、憲法改定のReferendumは国民投票にかけられなければならない。この場合署名を集める必要はないが連邦政府と議会の承認が必要。もう一つのReferendumは政府の法改正に対して緊急に異議を唱える場合に5万人以上の署名を100日以内に集めて国民投票を求めるもの。この場合連邦政府と議会の承認は必要ない。その後国民発議委員会は草案を連邦政府の担当行政府に提出する。担当行政府はこの草案を憲法、法律、判例、諸権利、国際条約に矛盾していないか審査する。審査を通った暁には草案は内閣と議会に提出され、連邦行政府と連邦議会はそれぞれの委員会で国民投票に向けての作業を開始する。内閣と議会には草案に対する対案を提出する裁量権が与えられており、これにより発議委員会には草案を撤回する余地が残される。最終的に内閣と議会は独自の見解を示し、国民には事実と数字を基にした政府の方針に沿って投票をするよう推奨する。国民投票の期日が近くなると(3週間前位)国民には投票用紙と議案の内容を説明した小冊子が住民登録している自治体から郵送されてくる。各政党、団体、報道機関も独自の政治的見解をメディアを通して発表し、草案とInitiativeについて国民投票の日を迎えるまでのキャンペーン期間中国民が議論をすることになる。

 

前述の終身刑の国民発議委員会が出来た背景には、仮釈放中に暴行殺人に及んだ「ゾリカーベルグ*の殺人」、「複数の子供を殺害したヴェルナー・フェラーリ」、「ロマンド(仏語圏)のサディスト」等社会を震撼させた事件がある。その主張は、保釈中の犯罪者は再犯を犯しやすいので関係法規を変えるべきで、精神病の分野で新しい科学的な根拠が確立された場合を除いて終身刑の受刑者にこれ以上仮釈放や執行猶予を与えないよう法整備を求めるもの。こうした犯罪者は服役中模範囚である場合が多く、被害者の親族関係者・地域住民は犯人出所後に対して深刻な不安を抱えて発議に至った。これに対するメディアの反論で印象的な点は、先ず何故十分な法的アドヴァイスを受けずに草案を作成したのかを糾している。<極端に危険>というあいまいな定義は刑法にはなじます、「高い累犯の危険性」「非常に危険」「治療不可能」という草案の文言は法令の条文としては不充分で裁判所の独立性を損ないかねない点を指摘している。更に新しい科学的な根拠は常に反証される危うさがあるとも説いている。法的根拠を度外視した国民発議が国民投票にかけられる危険性を指摘している。犯罪の基準を曖昧にすれば、国民の権利を損なうことにも繋がり、絶対的な国民の安全を保障する等幻想だと結論付けている。

 

もう一つの議案、高速道路の建設要求<Avanti>には政府が対案を出すことを約束して、国民発議委員会は提案を引っ込め、今回は政府の対案が国民投票の対象となっている。ゴットハルト・トンネルの大火災後、二つ目のトンネルの建設を求め、更なる最新設備の高速道路を造るよう求める道路族に対して、環境保護の優先を求める勢力が各自の支持政党と共にキャンペーンを繰り広げ、巨額の予算を必要とする議案である事から最も熱い論戦が戦わされている。更には、スイスの高速道路は一部が南北を繋ぐ国際道路にもなっている為、国家間の交渉案件ともなっている。政府は広域的な交通政策として、貨物輸送には近隣諸国と共同で鉄道網を強化し、自動車道と平行して運用する事を提案している。議案2について、政府は2003年に否決されたスイス借家人連盟の」発議<公正な家賃を認めろ>を基に関係法である「賃借り法」の部分的修正案を国民投票にかけるべく提出した。左派勢力を中心に政府の修正案に反対の意向を表明しているものの、争点は政府提出の「住宅ローン金利の基準」に集まっており、是か否かの判断は持家組みか賃借組みかで意見は分かれそうだ。

 

国民投票や住民投票には、とかく付和雷同性が伴いやすい傾向は否めず、国民が軽い気持で判断した結果、悪くすると我が身だけではなく同胞や国をも困難に巻き込んでしまう危険性を孕んでいる事を思い起こさせられる。日本のような間接民主主義制度の国とて国民が国会議員を選ぶのだから、スイスのような直接民主主義制同様国民の見識を問われる事に変わりはないものの、問題意識の持ち方では国民投票や住民投票で個別の意見を求められる方が分かり易く、一票の重みが増して権力者の暴走を食い止める歯止めにはなりそうな気がする。今憲法改定論議が活発になりつつある日本も、憲法を変えるには誰でもない国民自身が直接是非を決する国民投票が行わなければならない事を知る人は少なく、司法関係者の中にさえ知らない人が居ると漏れ聞いた!そしてスイスとの大きな違いは国民投票が論議されても、国民発議には左程関心が向けられていないような印象を受ける点だ。いずれにしても、一寸の虫のような存在の筆者ではあるが、スイスと日本両国の選挙権を与えられている身だけに、政治に目を向け国民としての責任を果たさねばと改めて思っている。

In Japan, we hardly hear it nowadays, but in the past, there was an expression that even a worm will turn. It seems that it was used when unknown citizen or weak people expressed their will or opinion. That meaning had never occurred to me before; it describes the principle of democracy. Recently arguments and discussions about the Japanese constitution have become active in Japan, and I learned that the government and ruling parties as well as opposition parties have started to examine the draft bill. Reports of mass media regarding to the national vote on a referendum and initiatives in Switzerland on February 8 of this year reminded me that for people who are busy to win their daily bread, it is very difficult to be assertive without possessing a deep understanding.

 

Three bills are proposed this time. The first bill is the so called Avanti-Counterproposal by the government that was suggested against the initiative of (Swiss Touring Club, an automobile association) that demanded more motorways. The second bill is an amended bill by the government regarded as an indirect counterproposal of the initiative Yes for fair lease proposed by the Swiss Association of Tenants and voted down (rejected) in 2003. The third bill is the Initiative for Life-long imprisonment (custody) launched by a initiative committee that claims life-long imprisonment without any parole for sexual and violent crime offenders that are extremely dangerous and not apt to therapeutic measures. Starting from the second week of January, mass media began gradually to report about the referendums and the initiative. I tried to ask some people about the bills, but they replied that they hadn’t study the matter yet; neither had I done it. We have to wait for the intense of public interest regarding to the bills until the polling documents are provided.

 

The initiative, one of the three bills, regarding to life-long imprisonment without parole for incurable, extremely dangerous criminals reminded me specially the significant and severe responsibility of the people. At first without careful consideration, I found no reason to oppose the bill, but reports and analysis in the press warned about the contents of the initiative. Major newspapers made comments against the initiative; the government and the parliament had rejected it too. The committee has no support from political parties or big organizations so far due to a lack of objectivity of the initiative. The initiative committee could collect 200,000 signatures, an exceptional big number considering the background that it has become more difficult to carry out a signature collection campaign since the introduction of the postal ballot system. The government suggested a revision of the present law regarding to the gap in it considering the initiative; the actual national vote this time could also be considered as a judgment about the government revision. The public however is not yet fully convinced that the revision of the law is more appropriate than the initiative launched by the committee. The government or the specialists focus their points of view rather on legal reasons whereas the public thinks more the emotional way.

 

Let me briefly explain about the Swiss system of national vote structured with Initiative and Referendum that is a unique system of Switzerland. At first about a national Initiative, citizens who want to launch an initiative have to collect at least 100,000 legally confirmed signatures within a period of 18 months. On the other hand, there are two kinds of referendum. One is the compulsory referendum regarding to constitutional amendments that are compulsory subjected to a national public vote. In that case no collection of signatures is requested. The second type is called the facultative referendum regarding to legal amendments and laws; in such a case a minimum of 50,000 signatures has to be collected within a period of 100 days. That action is followed then by a national public vote. Afterwards the committee has to submit a draft bill (initiative text) to the federal government administration department. The draft bill has to be legally examined with regard to constitution, law, justice, rights and international agreements and approved by the appropriate authorities. Once the initiative has passed those procedures it will be passed on the government and the parliament. The federal administrations as well as parliament committees are going to work on the initiative. It is up to the government or the parliament to make a counterproposal to the initiative so that the committee has the possibility to withdraw their initiative. Finally, the government and the parliament explain their views and deputes vote about the bill; the government makes a voting recommendation to the citizens based on facts and figures. When the polling day approaches (about three weeks before), voters receive their ballot paper (certificate) and an information booklet distributed by the local administration of the electorate’s place of residency. Political parties, organizations, and press report and express their own opinions about the political matters. Bills and initiatives are discussed in public during a certain campaigning period.

 

The aforementioned initiative committee who launched the <life-long imprisonment> initiative was created based on the background of a criminal who committed a violent murder during a prisoner’s leave; the case was called the <Murder of Zollikerberg*>, or the case of <Werner Ferrari who killed many children>, called the <masochist of Romand> that shook Swiss society. The committee explains that such criminals have a high recidivism rate requesting a reform of the relevant law; the sentence with life-long imprisonment should offer no more possibility for prisoner’s leave or probation unless new established scientific evidence regarding to the field of psychiatric illness is provided. Many criminals of that kind are often exemplary prisoners, therefore, relatives or local people of victims have serious anxiety during the parole period, and based on such fears the launched and support the initiative. The most important points discussed in press or mass media against the initiative is why the committee did not ask for legal advice before preparing the draft bill? It is explained that there are no legal terms written in a law such as <extremely dangerous>, <high risk regarding to repeated offence>, <very dangerous>, and <irremediable>; those expressions are insufficient as a legal terms and could possibly violate the independency of a court. It was further explained that new scientific verification could always be accompanied by negative evidence. It was pointed out to the danger that such a draft bill could ignore or not fully comply with the law. The final conclusion was that, if criteria in the criminal code are made unclear, it could violate the people’s rights, making the further ensuring of public safety an illusion.

 

Regarding to the other bill called <Avanti>, requesting the construction of further motorways, the initiative committee withdrew their initiative because the government promised to submit a similar kind of counterproposal that is the subject of the present vote. After the Gotthard tunnel inferno (crash and fire), motorway lobbyists demanded the construction of a second tunnel and further motorways providing appropriate facilities to road traffic; on the other hand however, people requested that priority be put on the protection of the environment. This bill regarding to the <Avanti> needs an enormous budget that’s why the hottest controversies are carried out on that subject. Furthermore, Swiss motorways are partly international road axes linking the north with the south; therefore, such a matter might also have to consider international agreements or contracts. The government proposes measures for the agglomeration (settlement area) to enhance railway cooperating with neighbouring countries for cargo transport; parallel measures would be introduced considering the railway and motorway road system. About the second bill, the government introduced a partial amendment of the relevant law based on the rejected initiative of Yes for fair lease by the Swiss Association of Tenants in 2003; mainly the left wing side opposes the amended bill. So far the argument point focuses on <the criteria of the mortgage interest rate> suggested by the government, therefore, people’s opinion could depend on their personal situation whether someone is a tenant or a house owner.

 

The results of a public vote regarding to an Initiative or a referendum, show often elements of behaviour like a flock of sheep that follow blindly one another. It reminds me when a nation that makes rush judgements, the results involves not only the voters, but could put also the whole nation in danger. A nation that has an indirect democratic system like Japan, people (citizens) choose their representatives for the parliament, therefore, they are held responsible for the politics of their deputes, it is the same like a nation with a direct democratic system such as Switzerland. However, I think, it is more comprehensive to be asked an individual political view by an initiative or a referendum, and a vote can be more valuable in order to apply as a brake to prevent the government and the politicians in power to run out of control. Arguments of constitutional reform have become active in Japan these days; I learned however that very few people, even many legal advisers or judiciary experts do not know that an amendment of the Japanese constitution is subjected to a public vote!! I’ve got the impression that the most important difference between Japan and Switzerland is the lack of knowledge and discussion regarding to the political instrument of the initiative by the citizens. So far the discussion turned only around the instrument of the referendum, but not the initiative. Anyway, my existence is just a small as an inch of worm, however, I was granted the suffrage as Swiss and Japanese national, therefore, and I reaffirm my responsibility as citizen showing the necessary political consciousness.

In Japan hört man ihn heutzutage selten, aber in der Vergangenheit gab es einen Ausdruck, dass sich sogar ein Würmchen dreht. Es scheint, dass er verwendet wurde für den Fall, dass unbekannte Bürger oder schwache Persönlichkeit ihren Willen oder Meinung ausdrückten. Diese Bedeutung war mir vorher nicht bewusst; damit wird das Prinzip der Demokratie beschrieben. Kürzlich wurden Argumente ausgetauscht und die Diskussion wegen der Japanischen Verfassung bekam aktiv in Japan. Ich habe gehört, dass in diesem Zusammenhang Regierung und Oppositions-Parteien begonnen haben den Verfassungs-Entwurf zu studieren. Berichte in den Schweizer Medien betreffend der Volksabstimmung vom 8. Februar 2004 über eine Initiative und ein Referendum in der Schweiz machten mich darauf aufmerksam, dass es sehr schwierig ist ein tiefes Verständnis der gewöhnlichen Bürger dafür zu gewinnen, da diese Leute damit beschäftigt sind ihr tägliches Brot zu verdienen.

 

Drei Vorlagen werden dieses Mal zur Abstimmung vorgeschlagen. Die erste Vorlage ist der so genannte <Avanti-Gegenentwurf> vom Bundesrat und einer Mehrheit des Parlaments; als Grundlage diente die Initiative (Schweiz. Touring Club), die sichere und leistungsfähigere Autobahnen verlangte. Die zweite Vorlage ist ebenfalls ein Gegenentwurf zur im 2003 abgelehnten Volksinitiative <Ja zu fairen Mieten>; Bundesrat und Parlament haben dazu eine Änderung des Mietrechts beschlossen. Die dritte Vorlage ist eine Initiative zur <Verwahrung gefährlicher Straftäter>; dass Initiativekomitee verlangt die lebenslange Verwahrung ohne Überprüfung und Hafturlaub, für nicht therapierbare, extrem gefährliche Sexual- und Gewaltstraftäter. In der zweiten Januar-Woche 2004 haben die Medien allmählich begonnen über die Abstimmung zum Referendum und zur Initiative zu berichten. Ich fragte einige Personen im meinen Bekanntenkreis über die Vorlagen der Volksabstimmung; die Leute antworteten dass sie das Thema noch nicht studiert hätten. Ich selber hatte die Vorlagen zu diesem Zeitpunkt auch noch nicht studiert. Wir müssen noch zu warten mit dem tieferen Interesse des Volkes in Bezug auf die Vorlagen bis die Abstimmungs-Unterlagen verschickt sind.

 

Die Initiative, eine der drei Vorlagen, bezüglich der lebenslangen Verwahrung ohne Überprüfung und Hafturlaub für nicht therapierbare, extrem gefährliche Straftäter, erinnert mich besonders stark an die hohe Verantwortung des Volkes. Anfänglich, ohne sorgfältige Überlegung, fand ich keinen Grund gegen diese Vorlage, aber Berichte und Analysen der Presse warnten über den Inhalt der Initiative. Bedeutende nationale Zeitungen machten Kommentare gegen die Initiative; der Bundesrat und das Parlament hatten diese ebenfalls abgelehnt. Das Komitee erhielt keine Unterstützung von politischen Parteien oder grossen Organisationen aufgrund eines Mangels an Objektivität der Initiative. Das Initiativkomitee konnte eine ungewöhnlich grosse Anzahl von 200 000 gültigen Unterschriften sammeln, das ist aussergewöhnlich, auch unter dem Hintergrund, dass es teilweise immer schwieriger wird einen Unterschriftensammlungs-Feldzug durchzuführen seit der Einführung des brieflichen (postalischen) Abstimmungssystems. Bundesrat und Parlament schlugen eine Verschärfung der einschlägigen Bestimmungen des Strafrechts vor um einzelne Lücken im Gesetz zu schliessen. Die Volksinitiative wurde jedoch bereits vorgäng dazu eingereicht. Die Volksabstimmung könnte dieses Mal auch als Meinungsäusserung zur Revision der entsprechenden Gesetzesartikel betrachtet werden. Das Volk ist jedoch noch nicht vollständig überzeugt, dass die Revision des Strafgesetzs besser ist als die Volksinitiative, insbesondere deshalb weil das revidierte Gesetz noch nicht in Kraft ist. Die Regierung und die Rechtsexperten konzentrieren ihren Blickwinkel hauptsächlich auf rechtliche Gründe währenddem für das Volk und das Komitee mehr emotionelle und menschliche Überlegungen im Vordergrund stehen.

 

Lassen Sie mich kurz das einzigartige Schweizer Volksabstimmungs-System, gegliedert nach Referendum und Initiative erklären. Zu erst zur Volksinitiative, Bürger die eine Volksinitiative starten möchten, müssen mindestens 100 000 rechtlich gültige und bestätigte Unterschriften sammeln, innerhalb von 18 Monaten. Auf der anderen Seite, gibt es zwei Arten von Referendum. Eines davon ist das obligatorische Referendum bezüglich Änderungen der Bundesverfassung. Im diesem Fall ist keine Unterschriftensammlung erforderlich. Der zweite Typ ist das so genannte fakultative Referendum bezüglich rechtliche und gesetzliche Änderungen; in einem solchen Fall müssen mindestens 50 000 Unterschriften innerhalb von 100 Tagen gesammelt werden. Dieser politischen Aktion folgt dann eine Volksabstimmung. Bezüglich einer Initiative muss das Komitee einen Entwurf an da zuständige Departement in der Regierungsadministration einreichen. Der Entwurf muss rechtlich geprüft werden in Bezug auf Verfassung, Gesetz, Justiz, Rechte und internationale Vereinbarungen und von den Behörden akzeptiert werden. Hat die Initiative dieses ganze Verfahren durchlaufen und überstanden, dann wird sie dem Bundesrat und an das Parlament weitergeleitet. Die Administration des Bundes sowie die Kommissionen des Parlamentes bearbeiten und studieren den Vorschlag und können einen Gegenvorschlag zur Initiative machen. Das Komitee hat dann die Möglichkeit ihre Initiative zurückzuziehen falls es mit dem Gegenentwurf der Regierung zu frieden ist. Schlussendlich geben Bundesrat und Parlament ihre Meinung und ihren Standpunkt bekannt und über die Initiative wird im Parlament abgestimmt. Die Regierung gibt dem Volk Abstimmungsempfehlungen und präsentiert die Fakten und Zahlen dazu. Sobald sich der Tag der Abstimmung nähert (zirka drei Wochen vor), erhalten die Stimmbürger die Abstimmungszettel und die Stimmrechtsausweise sowie eine Informationsbroschüre. Diese Unterlagen werden von der lokalen Wohnsitz-Gemeinde zugeschickt (Ort wo der Bürger registriert ist). Politische Parteien, Organisationen, und Medien berichten über die kommende Abstimmung und geben ihre Meinungen zu diesen politischen Themen ab. Vorlagen und Initiative werden in den Wochen vor der Abstimmung eifrig diskutiert im Volk und in den Zeitungen werden täglich Leserbriefe veröffentlicht.

 

Das eingangs erwähnte Initiativkomitee welches die Initiative <lebenslange Verwahrung> gestaltet und gestartet hat, bezieht sich für ihre Initiative auf den Hintergrund von Straftaten welche von Gewaltstraftätern, begannen oder versucht wurden, währenddem sie auf Hafturlaub waren. Es handelt sich um die Fälle des <Mörders vom Zollikerberg>, oder jener von <Werner Ferrari der mehrere Kinder tötete>, oder der <Masochist von Romont>; diese Gewaltverbrechen lösten in der Bevölkerung in der Schweiz einen Schock aus. Das Initiativkomitee erklärte, dass solche Kriminelle eine hohe Rückfall-Quote hätten und verlangte eine Reform des entsprechenden Gesetzes. Die Verurteilung zu lebenslanger Verwahrung sollte keine Möglichkeit für Hafturlaube und Bewährung mehr erlauben, es sei denn <neue wissenschaftliche Erkenntnisse> bezogen auf die psychiatrische Krankheit würden nachgewiesen und vorgelegt. Viele solche Kriminaltäter sind oft vorbildliche Gefangene, weshalb Angehörige oder lokale Bekannte der Opfer grosse Angst und Sorge leiden während dem Hafturlaub eines solchen Strafgefangenen. Die Initiative wurde basierend auf diesen Hintergründen gestartet und unterstützt. Der wichtigste Punkt welcher in der Presse oder den Massenmedien häufig diskutiert wurde und gegen die Initiative sprach war, warum hat das Komitee keine juristischen Ratschläge oder Beratung eingeholt, bevor sie den Entwurf vorbereitete? Es wird erklärt, dass es keine juristische Bezeichnungen im einem Gesetz gibt, welche als Beispiel die Begriffe <extrem gefährlich>, <hohe Gefährdung auf Rückfälligkeit>, <sehr gefährlich>, und <unheilbar> kennen oder verwenden. Solche Ausdrücke sind mangelhaft als juristische Begriffe und verletzen möglicherweise die Unabhängigkeit eines Gerichts. Es gibt noch weitere Erklärungen, dass neue wissenschaftliche Erkenntnisse mit negativen Zeugenaussagen begleitet sei könnten. Es wird betont und auf die Gefahr hingewiesen, dass ein solcher Entwurf dem Gesetz widersprechen oder nicht mit ihm im Einklang stehen könnte. Die Schlussfolgerung ist, dass falls die Kriterien im Strafgesetzbuch unklar formuliert sind, dass solche Bestimmungen die Rechte der Menschen verletzen könnten und damit die Garantierung der öffentlichen Sicherheit zu einer Illusion würde.

 

Bezüglich der anderen Vorlage mit dem Namen <Avanti>, wird ein weiterer Ausbau der Autobahnen gefordert; das Initiativkomitee zog ihre Initiative bereits zurück, weil Bundesrat und Parlament einen  ähnlichen Gegenvorschlag unterbreiteten welcher das Thema der kommenden Abstimmung ist. Nach dem Gotthardtunnel-Brand-Inferno, fordern Autobahn-Lobbyisten den Bau einer zweiten Tunnelröhre am Gotthard und weiter leistungsfähigere Autobahnen. Auf der anderen Seiten, verlangen die Leute Priorität für den Umweltschutz. Der Gegenentwurf zur <Avanti-Initiative> braucht ein enormes Budget, weshalb hitzig darüber diskutiert wird. Schweizer Autobahnen dienen teilweise als Verbindung für internationale Strassen von Nord nach Süd; bei einem solchen Thema sind deshalb auch internationale Verträge zu berücksichtigen. Der Bundesrat und das Parlament beantragen Massnahmen im Nahverkehr der Städte und die Förderung des Güter-Transportes mit der Eisenbahn und in diesem Zusammenhang eine Verbesserung der Zusammenarbeit mit den Behörden der Nachbarländer; parallele Massnahmen würden eingeführt unter Berücksichtigung von Strasse (Autobahnen) und Schiene (Eisenbahn). Betreffend der zweiten Vorlage, machte der Bundesrat und das Parlament einen indirekten Gegenvorschlag betreffend dem relevanten Gesetz basierend auf der abgelehnten Initiative <Ja zu fairen Mieten>, welche vom Schweizer Mieterinnen- und Mieterverband gestartet und im 2003 abgelehnt wurde. Vorrwiegend die politische Linke lehnt die Gesetzesrevision ab. Der Diskussionspunkt konzentriert sich auf <das Kriterium über die Hypothekarzinsen> beim Mietpreis vorgeschlagen vom Bundesrat und vom Parlament; die Meinungen der Leuten können deshalb vom persönlichen Zustand abhängen, ob jemand Mieter oder Haus-Eigentümer ist.

 

Das Ergebnis einer Volksabstimmung betreffend einer Initiative oder einem Referendum, zeigt oft grundlegende Verhaltensweisen, dass die Leute blind einander folgen, fast wie eine Herde von Schafen. Dieses Verhalten löste bei mir Gedanken aus, dass wenn ein Volk schnelle unüberlegte Entscheidung trifft, dass vom Ergebnis nicht nur die Wähler selber betroffen werden , sondern eine solche Entscheidung ein ganzes Volk in Gefahr bringen kann. Ein Volk mit einem System der indirekten Demokratie wie Japan, die Leute wählen ihre Repräsentanten für das Parlament, das heisst sie übernehmen die politische Verantwortung für ihre gewählten Repräsentanten; dies ist gleichwertig wie eine Nation mit einem direkten Demokratie-System wie die Schweiz, wo die Bürger teilweise direkt verantwortlich sind. Trotzdem denke ich, dass es verständlicher ist, eine individuelle politische Meinung durch eine Initiative oder Referendum zu fragen, und dass eine Abstimmung mehr Wert und Bedeutung haben kann. Eine solche Entscheidung kann bewirken, dass Regierung und Politiker realisieren, dass das Volk nicht einverstanden ist, wenn die politischen Entscheidungen ausser Kontrolle geraten. Argumente im Zusammenhang mit der bevorstehenden Verfassungsreform wurden aktiv in Japan in diesen Tagen. Ich habe jedoch verstanden, dass sehr wenige Leute, sogar viele juristische Fachpersonen oder gerichtliche Experten nicht wissen, dass Änderungen der japanischen Verfassung durch eine Volksabstimmung genehmigt werden müssen!! Ich habe den Eindruck, dass der grösste Unterschied zwischen Japan und Schweiz die fehlenden Kenntnisse und Diskussionen betreffend die politischen Rechte, unter anderem der Volksinitiative, sind. Die Diskussion befasste sich bis jetzt fast ausschliesslich mit dem Referendum, aber nicht im speziellen mit der Initiative. Meine Existenz ist nur wie diejenige eines kleinen Würmchens, trotzdem erhielt ich das Stimmrecht als Schweizer- und japanische Bürgerin, deswegen bekräftige ich hiermit nochmals meine Verantwortung als Bürgerin indem ich mein politisches Bewusstsein zeige und wahrnehme.

Initiative du peuple et référendum

< Même un petit ver (citoyen) a le droit de vivre >

De nos jours cette expression ″même un petit ver a le droit de vivre″est rarement utilisée mais autrefois elle était courante. Cette expression était utilisée lorsqu’un citoyen inconnu ou une personne ordinaire voulait exprimer son opinion ou souhait. Jusqu’à présent, sa signification m’était inconnue. Elle peut s’appliquer à la notion de démocratie. Tout récemment au Japon, des arguments et discussions s’échangent en ce qui concerne la constitution japonaise et j’ai appris que le gouvernement, les partis gouvernementaux ainsi que les partis de l’opposition vont examiner un nouveau projet de lois. Lorsque je regarde les articles de presse concernant les votations du 8 février 2004, je m’aperçois que pour un simple citoyen qui ne possède pas de connaissances  politiques approfondies, il est très difficile d’être catégorique.

 

Cette fois, trois projets seront soumis au peuple. Le premier est intitulé ″le contre-projet Avanti″. Le 28 novembre 2002, le Comité d’initiative Avanti (Touring Club Suisse) a déposé l’initiative populaire ″Avanti – pour des autoroutes sûres et performantes″ sous la forme d’un projet. Le deuxième est intitulé ″pour des loyers loyaux″. Il a été déposé le 14 mai 1997, par l’Association suisse des propriétaires. L’initiative a été rejetée par le Conseil fédéral et par le Parlement, qui lui ont opposé un contre-projet indirect sous la forme d’une révision partielle du droit du bail dans le code des obligations. L’aspect essentiel de la révision proposée concerne l’abandon de l’indexation des loyers sur le taux hypothécaire au profit de leur indexation sur l’indice suisse des prix à la consommation, ceci à raison de 100% des variations de l’indice. S’agissant des transferts d’immeuble, le bailleur peut procéder, dans le cadre des loyers comparatifs, à une augmentation annuelle de 10% maximum. Le troisième sujet est intitulé ″internement  à vie pour les délinquants sexuels ou violents jugés très dangereux et non amendables″. Déjà à partir de mi-janvier, graduellement les médias nous informent sur les sujets de ces votations. A cette époque, j’ai demandé à plusieurs personnes de connaître l’enjeu de ces votations mais personne n’avait encore une idée fixe sur les sujets et moi non plus. L’intérêt du public se manifeste lorsque la documentation officielle des votations nous parvient par la poste.

 

A mon avis, le peuple porte une lourde responsabilité sur une de ces trois initiatives, sur celle concernant l’internement à vie pour les délinquants sexuels et jugés très dangereux. Au premier abord, je ne voyais aucune raison d’être opposé à cette initiative mais après considération le contenu de cette initiative m’a fait réfléchir. La majorité des commentaires de la presse était contre cette initiative et elle a été également rejetée par le gouvernement. Le comité d’initiative n’a reçu aucun soutien de la part du gouvernement ou des partis gouvernementaux et ceci est dû au manque d’objectivité de l’initiative. Il a pu récolter  200'000 signatures, nombre exceptionnel vu que depuis l’introduction du vote par correspondance il est devenu plus difficile de rassembler une campagne de signatures. A cause de lacunes dans la constitution, le gouvernement a mis en place une révision de la présente loi. Le vote du peuple reflètera le regard de celui-ci vis à vis de la révision de cette loi. Le peuple n’est pas entièrement convaincu par cette révision. Son vote sera plus émotionnel et non basé sur des raisons légales.

 

Brièvement je veux vous expliquer comment fonctionne le système électoral provenant d’inititiatives et de référendums. Système unique à la Suisse. Les citoyens qui veulent lancer une initiative nationale doivent rassembler pendant une période de 18 mois au moins 100'000 signatures légales et confirmées. D’autre part, il y a deux sortes de référendum. Un référendum obligatoire qui concerne tout changement dans la constitution fédérale. Ce référendum doit être obligatoirement soumis au peuple par votation. Dans ce cas aucun rassemblement de signatures n’est nécessaire. Le second est le référendum facultatif, il concerne toute modification ou changement de loi. Dans ce cas un minimum de 50'000 signatures devront être recueillies pendant une période de 90 jours. Ce référendum facultatif sera soumis au peuple en votation populaire. Le comité d’initiative dépose un projet d’initiative à l’administration fédérale. Le contenu du projet doit être examiné légalement par celui-ci et doit répondre aux lois, aux droits et accords internationaux puis ensuite devra être approuvé par les autorités compétentes. Une fois que l’initiative a passé toutes ces procédures elle sera soumise au gouvernement fédéral et au parlement. L’administration fédérale ainsi que les commissions en charge du dossier devront encore travailler sur le texte de l’initiative. C’est au gouvernement et au parlement de décider s’ils acceptent l’initiative telle quelle ou  s’ils devront la soumettre à un contre-projet. A ce moment là, le comité d’initiative a la possibilité de retirer son initiative. Finalement, c’est au gouvernement et au parlement d’exprimer leur point de vue, de présenter et de soumettre la votation au peuple. Avec chaque documentation de vote, le citoyen reçoit des recommandations de la part du gouvernement. Quelques semaines avant la date de votation fixée, le citoyen recevra personnellement à son domicile un bulletin de vote accompagné de notes explicatives détaillées sur chaque sujet. Durant la campagne électorale, chaque parti politique, organisation aura la possibilité d’exprimer ses opinions ouvertement par voie de presse ou débat.

 

Le comité d’initiative concernant l ‘″internement à vie  pour les délinquants sexuels et dangereux″ a comme origine plusieurs histoires de meurtres horribles. Un des cas était  ″Werner Ferrari″ ou  ″le meurtrier du Zollikerberg″. Un autre se prénommait le ″sadique de Romont″ ; c’était l’histoire horrible de plusieurs assassinats. La population suisse a été très touchée par ces cas. Le comité d’initiative exige une révision de la loi car de tels assassins ont un risque élevé de récidive. Avec la sentence d’internement à vie, le condamné n’aura plus aucune mise en liberté anticipée et tout congé lui sera refusé. Le condamné pourra demander de nouvelles expertises de son cas seulement si de nouvelles connaissances scientifiques permettront d’établir que le délinquant ne représente plus aucun danger pour la collectivité. Beaucoup de ces criminels sont des prisonniers exemplaires et c’est pourquoi les parents des victimes ont de sérieuses peurs et ont voulu lancer cette initiative. La presse et les  médias ont critiqué cette initiative car elle présente une lacune. Lorsque le comité a préparé cette initiative, pourquoi n’a-t-il pas demandé l’avis de conseillers légaux au sujet de celle-ci. Dans la loi, il n’y a pas de termes légaux comme ″extrêmement dangereux″, ″à haut risque de récidive″ ou ″irrémédiable″. Ces expressions pourraient violer l’indépendance de la cour.  Il a aussi été mentionné que de nouvelles preuves scientifiques peuvent  toujours être accompagnées par de conséquences négatives. Les initiants ont ignoré de tels dangers et n’étaient pas conscients que cette initiative ne répondait pas à la loi. En conclusion :  si le code criminel n’est pas clair, il peut violer les droits de l’homme et la sécurité publique ne serait qu’une illusion.

 

En ce qui concerne l’autre initiative « avanti » qui revendique la construction de plus d’autoroutes. Le comité d’initiative a retiré son projet car le gouvernement leur a promis de soumettre au peuple une contre-proposition similaire qui fait l’objet de cette présente votation. Après la catastrophe dans le tunnel du Gothard (incendie suite à un accident), des automobilistes ont demandé la construction d’un second tunnel et une meilleure infrastructure routière. Cependant, la priorité pour le peuple suisse c’est la protection de l’environnement. Un autre point essentiel est le coût qu’entraîneraient ces constructions. De plus, notre système routier est situé sur un axe international nord-sud et tout traité ou accords internationaux doivent être considérés. Le gouvernement soumet une contre-proposition qui prévoit, dans le sens d’une politique coordonnée des transports, l’aménagement du rail et de la route en fonction de leurs avantages respectifs. Il présentera, un an après l’adoption du contre-projet, un programme intégré tant pour les routes nationales que pour le trafic d’agglomération.

 

En ce qui concerne la dernière initiative ″pour des loyers loyaux″, le gouvernement a proposé une modification du code de obligations (loyers) suite à cette initiative déposée par l’association des propriétaires en 2003. C’est principalement la gauche qui s’oppose à cette modification. L’argument principal est centré sur le critère ″des taux d’intérêts″ suggéré par le gouvernement. L’opinion du peuple dépendra du statut du citoyen : soit : il est propriétaire ou soit : il est locataire.

 

Souvent le résultat du vote dépend de l’attitude du citoyen. Souvent ce citoyen a la réaction du mouton ; il agira aveuglement et se laissera mener. Lorsqu’une nation porte un jugement trop rapide, les résultats n’engagent pas seulement les votants mais ils peuvent mettre en danger une nation entière. Dans une démocratie indirecte comme au Japon, les citoyens choisissent les représentants au parlement ; ce qui veut dire que c’est eux qui ont la responsabilité politique des représentants élus. Le cas est semblable pour un pays avec une démocratie directe telle que la Suisse. Cependant, je pense qu’il est plus juste de requérir à l’opinion du peuple par une initiative ou un référendum car un vote a plus de valeur et il peut prévenir tout abus de pouvoir de la part des politiciens ou du gouvernement. De nos jours au Japon, les arguments pour une réforme de la constitution sont d’actualité. Cependant, j’ai entendu que  très peu de gens, même certains conseillers légaux ou experts judiciaires ne savent pas qu’une modification de la constitution japonaise serait sujette au vote du peuple !!! J’ai l’impression que la plus grande différence entre les Japonais est les Suisses est le manque de connaissances des citoyens concernant les droits politiques et plus particulièrement les initiatives populaires. La discussion se focalise seulement sur le référendum et non sur l’initiative. De toute façon, je suis aussi petit qu’un ver mais cependant j’ai obtenu le droit de vote en tant que Suissesse et Japonaise c’est pourquoi j’endosse cette responsabilité en exerçant mon droit en toute conscience.
