国民投票2015年6月14日:

今回6月14日国民投票 *1) の議案は「生命倫理」、「後世代の育成」、「社
会経済」、「民主主義の支柱の一つ」と重要な案件ばかりで、思わず溜息が
出た。各テーマは既に何週間も前から報道で取り上げられていたので、感づ
いてはいた。しかし、いざ正面から向き合おうとするとずっしりと重みを感
じる。ボヤいていても事は進まないので、個別に見てみることにしよう。
1) 「人の生殖医療と遺伝子技術」の憲法改正連邦法(着床前遺伝子診断
/Praeimplantationsdiagnostik(PID):*2)
憲法修正案によって着床前遺伝子診断 (PID) を可能にする為、政府・議会
が議案を提出し、当然の事ながら賛成を推奨している。胚が子宮に着床する
前に重病の遺伝子の有無を検査出来るようにする。現状は不妊症の場合に限
り試験管ベビーの治療が許されている。遺伝病の家系の場合妊娠中に遺伝子
検査をすることになり、母体への負担と倫理的問題が発生する恐れがある。
議案はこれを避ける狙いがある。議案を支持しているのは主に中道政党と医
師達。反対しているのは保守と中道政党の一部に加えて身体障碍者団体。
PIDが生殖医療の緩和に繋がり、それに応じて胚の検査が遺伝子の病気だけ
でなく、ダウン症候群の様な染色体異常の検査にも許されるようになれば、
人間の生命の選択をするようになりかねないと不安視する人々がいる。又宗
教的な倫理観から議案の賛成にためらう人々も少なくない。しかし、議案は
抑制的で、個人的には母体と胎児保護の観点から議案を支持する。
2) 国民発議「奨学金イニシアティヴ」 /
Volksinitiative <Stipendieninitiative>: *3)
スイスでは教育ローンや奨学金などの公的教育支援はカントンの管轄で、カ
ントンによってサーヴィスは異なる。イニシアティヴ委員会 *4) は今日の
奨学金は不公平で不十分なので、将来連邦政府が全国一律に高等教育の支援
内容を定め、カントンは執行の責任を負うよう求めている。政府・議会は反
対の投票を推奨している。カントンは学生のニーズを連邦政府より知ってお
り、カントンは家族手当などで格差是正に努めているので、奨学金制度はカ
ントンの管轄に止めて置くべきという判断だ。この議案で連邦政府とカント
ンの財政負担が増加することにもなり、他の予算が削られる事になる。イニ
シアティヴは、連邦政府が地方の実情を理解していると錯覚し、連邦制では
なく中央集権を目指しているようだ。スイスの連邦制を損なう方向には慎重
であるべきと考える。
3) 国民発議「数百万の相続税を国民年金に」(相続税法改正)
/Volksinitiative
MMillionen-Erbschaften besteuern fuer unsere AHV
(Erbschaftssteuerreform): *5)
相続税と贈与税はカントンの管轄で、事実上全てのカントンが相続税と贈与
税を課している。配偶者は非課税扱いで、子供の相続税と贈与税も一部のカ
ントンで課税されている以外は非課税扱いだ。全てのカントンと自治体の税
収に占める相続税と贈与税の割合は2012年度で1.34%程度。遺産や贈与は2百
万スイスフラン迄一回限り非課税扱いで、それ以外は20%課税される。イニ
シアティヴはカントンの相続税を廃止して、連邦政府レヴェルの相続税と贈
与税を導入し、この税収の三分の二を国民年金に、三分の一をカントンに分
配するよう求めている。政府・議会は反対を推奨している。理由としては、
そもそも相続税は常にカントンの権限であった。カントンの経済的自立を確
保する税であることから廃止すべきでは無く、又企業の後継者や家族経営の
重荷になる等々。イニシアティヴが承認された場合を考慮して、2012年から
既に税金対策の贈与が進んでいる。高齢化が進みAHVの財源が不安視される
昨今ではあるが、AHVを連邦政府の管轄に変えるべきではない。築き上げた
連邦制をなし崩しにせず、AHVの財源確保は他の方法を模索すべきと思う。
4) ラジオとテレビの連邦法改正案 / Aenderung
des Bundesgesetzes ueber
Radio und Fernsehen (RTVG): *6)
政府・議会の提案したいわゆる放送法改正案だ。今日では携帯電話、タブレ
ットコンピュータ、PC等従来の受信機に依存しない方法でどこでもだれでも
ラジオやテレビが視聴出来る時代になった事から、政府・議会は全ての家計
と事業所に受信料を課すことにした。受信料は通常 Billag *7) の請求書を
元に銀行口座や郵便口座から自動で引き落とされている。テレビとラジオの
受信機調査を廃止できるので、受信料徴収の簡素化に繋がる。事業所の徴収
件数が増える分、家計にはこれまで年間462スイスフランだった受信料を400
スイスフランに負担を軽くするという案だ。収入の少ない家計は受信料を免
除される。事業所の受信料については、年間売り上げ50万スイスフラン以下
の場合は徴収されない。試算では4分の3の事業所が払わずに済む。合理的な
改革ではないかと思う。
4月末に発表された投票バロメーターで賛成が50%に達したのは「奨学金イニ
シアティヴ」だけだったが、「ラジオとテレビの連邦法改正案」は賛成が46
%で反対を上回ってはいた。「相続税イニシアティヴ」の賛成は38%と望み薄
で、「着床前遺伝子診断」は賛成が40%で反対が44%と微妙な情勢だった。投
票日の10日前に発表された5月末の投票バロメーターでは賛成が増えたのは、
「生殖医療連邦法修正案」の40%から46%だけだった。他の3議案の賛成は減
ってしまった。5月だけでもかなりの情報が伝えられ、情報の山に埋もれて
しまいそうだった。いずれにせよ、国民発議はスイスが連邦制を採用してい
るという基本を踏まえて議案を提案すべきと思う。地方自治が曖昧になり、
中央集権に比重が置かれる方向へ向かうのはスイス国民の本意ではない筈だ。

【 編集後記 】
日本では長らく中央集権体制から地方自治の拡充が試みられてきたが、未だ
に遅々として進んでいない。大切に育んできたスイスの地方自治を後退させ
ない為にも、国民投票を監視していなければならないと今回改めて思った。

The bills of this time of the national
voting on June 14 *1) are all
important matters such as
"Bioethics", "Development of later
generation",
"Socio-economy", and "One of the pillars of democracy",
and then sigh came out instinctively.
Each theme has been reported
by media already weeks ago, therefore,
I've perceived it. However,
if I tried to think about them, I felt
quite heavy. Grouching
doesn't help anything, so let's have a
look individually.
1) Federal Decree on the amendment of the
constitutional provision
for reproductive medicine and gene technology
involving human
beings (Pre-implantation Genetic Diagnosis): *2)
In order to allow pre-implantation
Genetic Diagnosis (PID), the
government and the Parliaments submitted
the amended constitution
article and as a matter of course, it was
recommended for approval.
Before the embryo is implanted in the
uterus, it enables to test for
the presence of serious genetic diseases.
The current situation
allows the test-tube fertilization only
in the case of infertility.
In case of a family history of genetic
disease, genetic tests are
done during pregnancy that possibly
causes a burden to the mother
and is an ethical issue; the constitution
article aims to avoid
that. The amended article is supported
mainly by centrist parties
and doctors. Opposed are conservatives
and part of the centrist
political parties as well as
organizations for disabled persons.
There are people who worry about that PID
can lead to a relaxation
of the reproductive medicine, and
accordingly the inspection of the
embryo might be allowed not only to
genetic diseases, but also to
chromosomal abnormality like Down’s
syndrome; it could come to the
selection of human life. Also not a few
people hesitate to be in
favor of the article due to the religious
ethical view. However, the
constitution article is restrictively
formed, therefore, personally
I would rather be in favor of the
viewpoint of protection of the
mother and fetus.
2) Popular initiative "Scholarship
Initiative": *3)
In Switzerland, the public education
assistance such as scholarships
and education loans is in the
jurisdiction of the Cantons, and the
service level is different depending on
the Canton. The initiative
committee *4) found that scholarships are
unfair and not sufficient
today, therefore, they claim that the
Federal Government is to
decide uniform regulations throughout of
the country. The Government
defines the conditions and the amount of
the education contributions
whereas the Cantons are responsible for
the implementation. The
Government and the Parliaments recommend
to vote against the
initiative. Their judgment is that the
Cantons know better the needs
of the students more than the Federal
Government. Disparities in
scholarships between Cantons consider
also family allowances,
therefore, the scholarship system should
remain in the jurisdiction
of the Cantons. The bill (initiative)
would also result in an
increasing financial burden of the
Federal Government and Cantons so
that other budgets had to be cut.
Evidently the initiative seems to
confuse that the Federal Government
understand local circumstances,
and it aims for centralization instead of
federalism. I think that
the undermining of the Swiss federal
system should be restricted.
3) Popular initiative
"Million-inheritances taxed for our AHV
(Inheritance Tax Reform)": *5)
Inheritance tax and gift tax are in the
jurisdiction of the Cantons;
actually, all of the Cantons impose
inheritance tax and gift tax.
The spouse is exempted from the tax. The
children are exempted from
the inheritance tax and gift tax too,
except in some few Cantons.
The proportion of inheritance tax and
gift tax corresponded to 1.34%
of all tax revenues of the Swiss Cantons
and Municipalities in the
fiscal year 2012. An amount of CHF 2
million of a heritage or gift
is exempted from the inheritance tax at
one-time, otherwise the
inheritance or gift is taxed at a rate of
20%. The initiative
requests to abolish the inheritance and
gift tax of the Cantons and
to introduce an inheritance tax and gift
tax at Federal level. Two
third of the tax revenue from such a
national tax should be
delivered to the AHV (National pension),
and one third of it to the
Cantons. The Federal Government and the
Parliaments recommend to
vote "No". The reasons are that
first of all, the inheritance and
gift tax was always a privilege of the
Cantons. These two taxes are
to ensure the economic independency of
the Cantons, therefore, they
should not be abolished. Furthermore, the
new tax becomes a burden
for corporate successors and family-run
business, and so on.
Considering the case of an approval of
the initiative, gifts since
2012 would be attributed to the bequest
and with it retrospectively
considered for tax purposes. Because of
aging, the funding of the
AHV (National pension) is a matter of
concern nowadays,
nevertheless, the AHV-funding should not
be change to the
jurisdiction of the Federal Government. I
think we should not
destroy the established federalism by
seeking to secure financial
resources for the AHV by other methods.
4) Amendment of the Federal Law on Radio
and Television (RTVG): *6)
The Government and the Parliaments
proposed the amendment of the so
called broadcast law. Nowadays, anyone
and anywhere can receive
radio or TV programs by mobile telephone,
tablet computer, and PC.
It does not depend anymore on the
conventional equipment; the
Government and the Parliaments want to
impose a subscription fee to
all households and business
establishments. Subscription fees are
normally automatically debited on a bank-
or postal account based on
the invoice of the collection body Billag *7). The control of the
TV/Radio-receivers (unlicensed viewers)
can be abolished that leads
to a simplification of the collection of
subscription fees. As the
number of establishments for collection
will increase, the burden of
the subscription fee per household will
decrease from the present
CHF 462 to CHF 400 per year. Low income
households are exempted from
the TV/Radio subscription fees. Whereas
the subscription fee for
offices is not levied below an annual
turnover of CHF 500,000.
Around 75% of all establishments need not
to pay the subscription
fee. I think that this is a reasonable
reform.
The results of the "Vote
barometer" (survey) announced at the end of
April were: in favor of the
"Scholarship Initiative" were only 50%
and in favor of the "Amendment of
the Federal Law on Radio and
Television" were 46%, however,
higher than the opposition votes.
Affirmative votes of the
"Inheritance Tax Reform" were hopeless with
only 38%, and in favor of the
"Pre-implantation Genetic Diagnosis"
were 40% whereas the opposition votes
were at 44%; the situation was
subtle. Ten days before the voting day as
of the end of May, the
"Vote barometer" announced that
the in favor-votes for the "Pre-
implantation Genetic Diagnosis" had
increased from 40% to 46%. With
regard to the other three proposals, the
in favor-votes had
decreased. The month of May alone brought
a considerable amount of
voting information; I was nearly buried
in a mountain of
information. Anyhow I think a bill
through a popular initiative
should be proposed based on the fact that
Switzerland has adopted a
federal system. The local autonomy should
not become ambiguous and
go towards centralization. That cannot be
the real intention of the
Swiss citizens.

It has been attempted to expand the local
autonomy from the
centralized system in Japan for a long
time. It has however hardly
progressed yet, not even at snail’s pace.
In order not to retract
the local autonomy in Switzerland, which
has carefully nurtured, I
think again the national voting must be
monitored.
